SENATE BILL

No. 1254 Session of 1998

                                     AN ACT

     1  Amending the act of October 4, 1978 (P.L.883, No.170), entitled,
     2     as reenacted, "An act relating to conflicts of interest
     3     involving certain public officials serving in State or State
     4     agencies and local political subdivision positions and
     5     prohibiting certain public employees from engaging in certain
     6     conflict of interest activities requiring certain disclosures
     7     and providing penalties," further providing for statements of
     8     financial interests.

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  Section 5(b)(6) and (7) of the act of October 4,
    12  1978 (P.L.883, No.170), referred to as the Public Official and
    13  Employee Ethics Law, reenacted and amended June 26, 1989
    14  (P.L.26, No.9), are amended to read:
    15  Section 5.  Statement of financial interests.

    17     (b)  The statement shall include the following information
    18  for the prior calendar year with regard to the person required
    19  to file the statement.

     1         (6)  The name and address of the source and the amount of
     2     any gift or gifts valued in the aggregate at [$200] $100 or
     3     more and the circumstances of each gift. This paragraph shall
     4     not apply to a gift or gifts received from a spouse, parent,
     5     parent by marriage, sibling, child, grandchild, other family
     6     member or friend when the circumstances make it clear that
     7     the motivation for the action was a personal or family
     8     relationship. However, for the purposes of this subsection,
     9     the term "friend" shall not include a registered lobbyist or
    10     an employee of a registered lobbyist. This paragraph shall
    11     not be applied retroactively.
    12         (7)  (i)  The name and address of the source and the
    13         amount of any payment for or reimbursement of actual
    14         expenses for transportation and lodging or hospitality
    15         received in connection with public office or employment
    16         where such actual expenses for transportation and lodging
    17         or hospitality exceed [$500] $100 in the course of a
    18         single occurrence. This paragraph shall not apply to
    19         expenses reimbursed by a governmental body, or to
    20         expenses reimbursed by an organization or association of
    21         public officials or employees of political subdivisions
    22         which the public official or employee serves in an
    23         official capacity.
    24             (ii)  This paragraph shall not be applied
    25         retroactively.

    27     Section 2.  This act shall take effect in 60 days.
