                                     AN ACT

     1  Providing matching grants to public or private regional entities  <--
     2     to promote exports; and making an appropriation.
     3  MAKING APPROPRIATIONS FROM THE PROFESSIONAL LICENSURE             <--
     4     AUGMENTATION ACCOUNT AND FROM RESTRICTED REVENUE ACCOUNTS
     5     WITHIN THE GENERAL FUND TO THE DEPARTMENT OF STATE FOR USE BY
     6     THE BUREAU OF PROFESSIONAL AND OCCUPATIONAL AFFAIRS IN
     7     SUPPORT OF THE PROFESSIONAL LICENSURE BOARDS ASSIGNED
     8     THERETO.
     9  PROVIDING FOR THE CAPITAL BUDGET FOR THE FISCAL YEAR 1988-1989.   <--

    10     The General Assembly of the Commonwealth of Pennsylvania
    11  hereby enacts as follows:
    12  Section 1.  Short title.                                          <--
    13     This act shall be known and may be cited as the Export
    14  Development Matching Grant Act.
    15  Section 2.  Definitions.
    16     The following words and phrases when used in this act shall
    17  have the meanings given to them in this section unless the
    18  context clearly indicates otherwise:


     1     "Department."  The Department of Commerce of the Commonwealth
     2  of Pennsylvania.
     3     "Program."  The Export Development Matching Grant Program.
     4  Section 3.  Export Development Matching Grant Program.
     5     The Export Development Matching Grant Program is hereby
     6  established in the Department of Commerce to encourage and
     7  facilitate regional export development programs and expertise,
     8  consistent with State efforts, in order to promote exports by
     9  awarding matching grants to qualified public or private regional
    10  entities. The department shall develop regulations to implement
    11  the program.
    12  Section 4.  Qualifying export development activities.
    13     Qualifying export development activities include, but are not
    14  limited to:
    15         (1)  Making studies, surveys and investigations.
    16         (2)  Traveling trade show displays.
    17         (3)  Printing costs.
    18         (4)  Consultant fees.
    19         (5)  Other similar activities approved by the department
    20     to promote regional export development programs through the
    21     local entities set forth in section 6.
    22  Section 5.  Grants.
    23     (a)  State share.--The State grant shall not exceed $20,000
    24  or one-half of the eligible cost of the project, whichever is
    25  less.
    26     (b)  Local share.--The local share of the project shall not
    27  be less than one-half of the eligible cost. Local entity
    28  matching funds may include Federal funds and local
    29  appropriations available to the grantees.
    30  Section 6.  Local entities.

     1     (a)  Eligible grantees.--Eligible grantees shall include:
     2         (1)  Public entities, such as economic development
     3     districts, local development districts, industrial
     4     development authorities and councils of government.
     5         (2)  Private entities, such as commercial or industrial
     6     development corporations, credit development corporations and
     7     chambers of commerce.
     8         (3)  Other similar nonprofit organizations promoting
     9     regional export development.
    10     (b)  Regional cooperation encouraged.--To encourage regional
    11  cooperation, local entities from two or more counties which join
    12  in applying for a grant will receive priority funding.
    13  Section 7.  Limitations.
    14     (a)  Continuing projects.--A grantee shall not utilize
    15  program moneys for a continuing project such as overseas trade
    16  representation.
    17     (b)  Annual limit.--No local or regional entity may receive
    18  more than one grant per State fiscal year.
    19  Section 8.  Reports.
    20     Each grantee shall provide the department with a final report
    21  which describes the progress made in fulfilling the purpose of
    22  the grant, an evaluation of the impact of the work performed and
    23  a financial report detailing all expenditures relating to the
    24  grant and the local matching fund, and which lists the sources
    25  of all local matching funds.
    26  Section 9.  Appropriation.
    27     The sum of $100,000, or as much thereof as may be necessary,
    28  is hereby appropriated to the Department of Commerce to fund
    29  grants under this act.
    30  Section 10.  Effective date.

     1     This act shall take effect July 1, 1988.
     2     SECTION 1.  THE SUM OF $12,218,000, OR AS MUCH THEREOF AS MAY  <--
     3  BE NECESSARY, IS HEREBY APPROPRIATED FROM THE PROFESSIONAL
     4  LICENSURE AUGMENTATION ACCOUNT WITHIN THE GENERAL FUND TO THE
     5  DEPARTMENT OF STATE FOR THE OPERATION OF THE BUREAU OF
     6  PROFESSIONAL AND OCCUPATIONAL AFFAIRS FOR THE FISCAL YEAR JULY
     7  1, 1988, TO JUNE 30, 1989.
     8     SECTION 2.  (A)  THE SUM OF $1,644,000, OR AS MUCH THEREOF AS
     9  MAY BE NECESSARY, IS HEREBY APPROPRIATED FROM THE RESTRICTED
    10  RECEIPTS ACCOUNT OF THE STATE BOARD OF MEDICINE, AS AUTHORIZED
    11  BY SECTION 907(A) OF THE ACT OF OCTOBER 15, 1975 (P.L.390,
    12  NO.111), KNOWN AS THE HEALTH CARE SERVICES MALPRACTICE ACT, FOR
    13  THE OPERATION OF SAID BOARD FOR THE FISCAL YEAR JULY 1, 1988, TO
    14  JUNE 30, 1989.
    15     (B)  THE SUM OF $312,000, OR AS MUCH THEREOF AS MAY BE
    16  NECESSARY, IS HEREBY APPROPRIATED FROM THE RESTRICTED RECEIPTS
    17  ACCOUNT OF THE STATE BOARD OF OSTEOPATHIC MEDICINE, AS
    18  AUTHORIZED BY SECTION 907(B) OF THE HEALTH CARE SERVICES
    19  MALPRACTICE ACT, FOR THE OPERATION OF SAID BOARD FOR THE FISCAL
    20  YEAR JULY 1, 1988, TO JUNE 30, 1989.
    21     (C)  THE SUM OF $129,000, OR AS MUCH THEREOF AS MAY BE
    22  NECESSARY, IS HEREBY APPROPRIATED FROM THE RESTRICTED RECEIPTS
    23  ACCOUNT OF THE STATE BOARD OF PODIATRY, AS AUTHORIZED BY SECTION
    24  907(C) OF THE HEALTH CARE SERVICES MALPRACTICE ACT, FOR THE
    25  OPERATION OF SAID BOARD FOR THE FISCAL YEAR JULY 1, 1988, TO
    26  JUNE 30, 1989.
    27     (D)  EACH APPROPRIATION LISTED IN SUBSECTIONS (A), (B) AND
    28  (C) SHALL NOT BE TREATED AS AN AUGMENTATION TO THE DEPARTMENT OF
    29  STATE, GENERAL GOVERNMENT APPROPRIATION, OR ANY OTHER
    30  APPROPRIATION, BUT SHALL BE TREATED AND ACCOUNTED FOR AS

     2     SECTION 3.  THE ADDITIONAL SUM OF $800,000, OR AS MUCH
     3  THEREOF AS MAY BE NECESSARY, IS HEREBY APPROPRIATED FROM THE
     4  PROFESSIONAL LICENSURE AUGMENTATION ACCOUNT WITHIN THE GENERAL
     5  FUND TO THE DEPARTMENT OF STATE FOR THE OPERATION OF THE BUREAU
     6  OF PROFESSIONAL AND OCCUPATIONAL AFFAIRS FOR THE FISCAL YEAR
     7  JULY 1, 1987, TO JUNE 30, 1988. THIS SUM SHALL BE AN ADDITION TO
     8  ANY APPROPRIATION UNDER THE ACT OF JULY 1, 1987 (P.L.458,
     9  NO.8A).
    10     SECTION 4.  THIS ACT SHALL TAKE EFFECT AS FOLLOWS:
    11         (1)  SECTIONS 3 AND 4 SHALL TAKE EFFECT IMMEDIATELY.
    12         (2)  THE REMAINDER OF THIS ACT SHALL TAKE EFFECT JULY 1,
    13     1988, OR IMMEDIATELY, WHICHEVER IS LATER.
    14  SECTION 1.  SHORT TITLE AND CONSTRUCTION.                         <--
    15     (A)  SHORT TITLE.--THIS ACT SHALL BE KNOWN AND MAY BE CITED
    16  AS THE CAPITAL BUDGET ACT OF 1988-1989.
    17     (B)  SUPPLEMENTS.--A REFERENCE TO THIS ACT SHALL BE DEEMED TO
    18  INCLUDE A REFERENCE TO THE SUPPLEMENTS TO THIS ACT.
    19     (C)  FISCAL CODE.--THE PROVISIONS AND DEFINITIONS OF ARTICLE
    20  XVI-B OF THE ACT OF APRIL 9, 1929 (P.L.343, NO.176), KNOWN AS
    21  THE FISCAL CODE, SHALL APPLY TO THIS ACT TO THE EXTENT THEY ARE
    22  NOT INCONSISTENT WITH THIS ACT.
    23  SECTION 2.  OVERALL LIMITATIONS ON DEBT TO BE INCURRED FOR
    24                 CAPITAL PROJECTS.
    25     THE MAXIMUM PRINCIPAL AMOUNT OF ADDITIONAL DEBT TO BE
    26  INCURRED DURING THE 1988-1989 FISCAL YEAR, AND THEREAFTER UNTIL
    27  THE ENACTMENT OF THE 1989-1990 CAPITAL BUDGET SPECIFYING THE
    28  MAXIMUM DEBT FOR THE 1989-1990 FISCAL YEAR, FOR CAPITAL PROJECTS
    29  SPECIFICALLY ITEMIZED IN A CAPITAL BUDGET PURSUANT TO SECTION
    30  7(A)(4) OF ARTICLE VIII OF THE CONSTITUTION OF PENNSYLVANIA, AND
