                                     AN ACT

     1  Authorizing and directing the Department of General Services,
     2     with the approval of the Governor, to grant and convey to
     3     Citizens Utilities Water Company of Pennsylvania, certain      <--
     4     PENNSYLVANIA AMERICAN WATER COMPANY, CERTAIN lands situate in  <--
     5     East Vincent Township, Chester County.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8  Section 1.  Conveyance in East Vincent Township, Chester County.
     9     (a)  Authorization.--The Department of General Services, with
    10  the approval of the Governor, is hereby authorized and directed
    11  on behalf of the Commonwealth of Pennsylvania to grant and
    12  convey Citizens Utilities Water Company of Pennsylvania, certain  <--
    13  CONVEY PENNSYLVANIA AMERICAN WATER COMPANY, CERTAIN lands         <--
    14  situate on the grounds of the former Pennhurst Center described
    15  in subsection (b) for fair market value as determined by
    16  independent appraisal and a water utility easement on the
    17  grounds of the former Pennhurst Center described in subsection
    18  (c) in exchange for five no cost transferable taps to the
    19  Grantee's water system for use by the Grantor (Commonwealth of

     1  Pennsylvania), its successors and/or assigns.
     2     (b)  Property description.--The property to be conveyed
     3  pursuant to this section consists of approximately 4.4171 acres
     4  of land bounded and described according to a Survey by Conver
     5  and Smith Engineering, Inc. dated September 27, 1996, Plan No.
     6  B-96-065, more particularly described as follows:
     7     BEGINNING at a corner of this and remaining lands of the
     8  Commonwealth of Pennsylvania and being also in the Southerly
     9  line of lands recently conveyed by the Commonwealth of
    10  Pennsylvania to the Owen J. Roberts School District, the said
    11  corner being also the three (3) following courses and distances,
    12  measured along the said Southerly line of lands of Owen J.
    13  Roberts School District from the Westerly proposed right-of-way
    14  line of Pennhurst Road (proposed to be 50 feet wide):
    15         (1)  South 75 degrees 26 minutes 03 seconds West 25.84
    16     feet to a corner;
    17         (2)  South 80 degrees 49 minutes 35 seconds West 89.60
    18     feet to a corner; and
    19         (3)  South 83 degrees 59 minutes 34 seconds West 263.21
    20     feet to the place of BEGINNING;
    21  thence from the place of BEGINNING, along the said remaining
    22  lands of the Commonwealth of Pennsylvania, South 10 degrees 43
    23  minutes 29 seconds East 391.56 feet to a corner in line of lands
    24  of Spring Hollow Golf Course, Inc.; thence along the same, North
    25  89 degrees 47 minutes 40 seconds West 399.54 feet to a corner of
    26  lands of Citizens Utilities Home Water Company and being the
    27  existing reservoir; thence along the same, the four (4)
    28  following courses and distances:
    29         (1)  North 05 degrees 15 minutes 00 seconds East 295.17

     2     feet to a corner;
     3         (3)  South 05 degrees 15 minutes 00 seconds West 295.17
     4     feet to an iron pin (found); and
     5         (4)  South 84 degrees 45 minutes 00 seconds East 295.17
     6     feet to a corner, again of lands of Spring Hollow Golf
     7     Course, Inc.;
     8  thence along the same, North 86 degrees 15 minutes 05 seconds
     9  West 457.67 feet to a concrete monument (found) and North 03
    10  degrees 42 minutes 57 seconds East 332.28 feet to a corner of
    11  the aforementioned lands recently acquired by the Owen J.
    12  Roberts School District; thence along the same, the four (4)
    13  following courses and distances:
    14         (1)  South 84 degrees 45 minutes 00 seconds East 370.14
    15     feet to a corner;
    16         (2)  North 80 degrees 27 minutes 00 seconds East 106.10
    17     feet to a corner;
    18         (3)  North 80 degrees 35 minutes 53 seconds East 128.88
    19     feet to a corner; and
    20         (4)  North 83 degrees 59 minutes 34 seconds East 162.35
    21     feet to the BEGINNING.
    22     CONTAINING 4.4171-acres, more or less.
    23  TOGETHER WITH the right of ingress, egress, and regress and
    24  installation and maintenance of an electric service over a
    25  certain 25-foot wide access easement for the exclusive use of
    26  Citizens Utilities Water Company of Pennsylvania, or its
    27  successor in function, extending from the Easterly boundary of
    28  the herein-described tract in an Easterly direction to the
    29  Westerly side of Pennhurst Road (proposed to be 50 feet wide)
    30  and being more fully described as follows:

     1     BEGINNING at a corner on the Westerly side of Pennhurst Road
     2  (proposed to be 50 feet wide) and being in line of lands
     3  recently acquired by the Owen J. Roberts School District; thence
     4  from the place of BEGINNING, along the proposed Westerly side of
     5  Pennhurst Road, South 11 degrees 05 minutes 52 seconds East
     6  25.05 feet to a corner; thence through lands of the Commonwealth
     7  of Pennsylvania, the three (3) following courses and distances:
     8         (1)  South 75 degrees 26 minutes 03 seconds West 25.50
     9     feet to a corner;
    10         (2)  South 80 degrees 49 minutes 35 seconds West 91.47
    11     feet to a corner; and
    12         (3)  South 83 degrees 59 minutes 34 seconds West 261.83
    13     feet to a corner in line of the above-described tract about
    14     to be acquired from the Commonwealth of Pennsylvania by
    15     Citizens Utilities Water Company of Pennsylvania;
    16  thence along the same, North 10 degrees 43 minutes 29 seconds
    17  West 25.09 feet to a corner in line of the aforementioned lands
    18  recently acquired by the Owen J. Roberts School District; thence
    19  along the same, the three (3) following courses and distances:
    20         (1)  North 83 degrees 59 minutes 34 seconds East 263.21
    21     feet to a corner;
    22         (2)  North 80 degrees 49 minutes 35 seconds East 89.60
    23     feet to a corner; and
    24         (3)  North 75 degrees 26 minutes 03 seconds East 25.84
    25     feet to the place of BEGINNING.
    26     (c)  Water utility easement description.--The water utility
    27  easement to be conveyed pursuant to this section consists of
    28  approximately 3.3980-acres of land bounded and described
    29  according to a Survey by Conver and Smith Engineering, Inc.
    30  dated July 16, 2001, Plan No. B-01-049, more particularly

     1  described as follows:
     2     BEGINNING at a corner (B) in the line dividing lands of the
     3  Commonwealth of Pennsylvania and lands of Citizens Utilities
     4  Water Company of Pennsylvania, the said corner being also North
     5  05 degrees 02 minutes 23 seconds East 391.29 feet, measured
     6  along the said line dividing lands of the Commonwealth of
     7  Pennsylvania and lands of Citizens Utilities Water Company of
     8  Pennsylvania from a corner (A) in the titleline of Brown Drive
     9  (private road, 50 feet wide); thence from the place of
    10  BEGINNING, along the said line dividing lands of the
    11  Commonwealth of Pennsylvania and lands of Citizens Utilities
    12  Water Company of Pennsylvania, North 05 degrees 02 minutes 23
    13  seconds East 21.82 feet to a corner (C), a concrete monument
    14  (found), a corner of lands of Richard A. Heckman and being on
    15  the Northerly side of the herein-described 20-foot wide water
    16  line easement; thence along the Northerly side of the herein-

    20  continuing along the Northerly side of the 20-foot wide water

    22  partly along lands of the Commonwealth of Pennsylvania, South 64

    24  in the bed of Brown Drive; thence still along the Northerly side
    25  of the herein-described 20-foot wide water line easement,

     8     feet to a corner (CD);
     9  thence leaving Brown Drive and extending through lands of the
    10  Commonwealth of Pennsylvania, along the Southerly side of the
    11  herein-described 20-foot wide water line easement, the two (2)
    12  following courses and distances:
    13         (1)  North 64 degrees 52 minutes 37 seconds West 472.74
    14     feet to a corner (CE); and
    15         (2)  North 61 degrees 22 minutes 37 seconds West 287.49
    16     feet to the place of BEGINNING.
    17     CONTAINING 3.3980-acres of land, be the same more or less.
    18     (d)  Conditions.--The conveyance shall be made under and
    19  subject to all lawful and enforceable easements, servitudes and
    20  rights of others, including but not confined to streets,
    21  roadways and rights of any telephone, telegraph, water,
    22  electric, gas or pipeline companies, as well as under and
    23  subject to any lawful and enforceable estates or tenancies
    24  vested in third persons appearing of record, for any portion of
    25  the land or improvements erected thereon.
    26     (e)  Deed of conveyance.--The deed of conveyance shall be by
    27  Special Warranty Deed and shall be executed by the Secretary of
    28  General Services in the name of the Commonwealth of
    29  Pennsylvania.
    30     (f)  Costs and fees.--Costs and fees incidental to this

     1  conveyance shall be borne by the Grantee.
     2     (g)  Alternate disposition.--In the event that this
     3  conveyance is not executed within 12 months of the effective
     4  date of this section, the property may be disposed of in
     5  accordance with Article 2406-A of the act of April 9, 1929
     6  (P.L.177, No.175), known as The Administrative Code of 1929.
     7     (h)  Disposition of proceeds.--The proceeds from the sale
     8  shall be deposited in the Purchasing Fund of the Department of
     9  General Services to defer costs associated with the disposition
    10  of the former Pennhurst Center property, and any proceeds
    11  remaining after the deferral of such costs shall be deposited to
    12  the General Fund.
    13  Section 2.  Effective date.
    14     This act shall take effect immediately.
