SENATE BILL

No. 1082 Session of 2006

                                     AN ACT

     1  Amending the act of November 10, 1999 (P.L.491, No.45), entitled
     2     "An act establishing a uniform construction code; imposing
     3     powers and duties on municipalities and the Department of
     4     Labor and Industry; providing for enforcement; imposing
     5     penalties; and making repeals," further providing for
     6     applicability.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 104(f) of the act of November 10, 1999
    10  (P.L.491, No.45), known as the Pennsylvania Construction Code
    11  Act, is amended to read:
    12  Section 104.  Application.
    13     * * *
    14     (f)  Application to swimming pools and spas.--
    15         (1)  The provisions of this act as they relate to
    16     swimming pools and spas shall not be applicable to those
    17     constructed or installed prior to the effective date of this
    18     act.
    19         (2)  All swimming pools and spas constructed or installed


     1     after the effective date of this act shall be governed by the
     2     requirements of this act, including section 503. All of the
     3     following apply:
     4             (i)  Except as set forth in subparagraph (ii), a
     5         swimming pool or spa subject to this paragraph may not be
     6         filled with water until all barrier and other
     7         requirements of this act are met.
     8             (ii)  The barrier requirements of subparagraph (i)
     9         may be waived by the department for filling an in-ground
    10         swimming pool if the swimming pool is enclosed by a
    11         temporary barrier which meets regulations promulgated by
    12         the department. A waiver under this subparagraph shall
    13         expire 14 days after issuance.
    14     Section 2.  Regulations promulgated under the addition of
    15  section 104(f)(2)(ii) shall be exempt from the act of June 25,
    16  1982 (P.L.633, No.181), known as the Regulatory Review Act.
    17     Section 3.  This act shall take effect in 60 days.
