AN ACT 1 Amending the act of April 12, 1951 (P.L.90, No.21), entitled "An 2 act relating to alcoholic liquors, alcohol and malt and 3 brewed beverages; amending, revising, consolidating and 4 changing the laws relating thereto; regulating and 5 restricting the manufacture, purchase, sale, possession, 6 consumption, importation, transportation, furnishing, holding 7 in bond, holding in storage, traffic in and use of alcoholic 8 liquors, alcohol and malt and brewed beverages and the 9 persons engaged or employed therein; defining the powers and 10 duties of the Pennsylvania Liquor Control Board; providing 11 for the establishment and operation of State liquor stores, 12 for the payment of certain license fees to the respective 13 municipalities and townships, for the abatement of certain 14 nuisances and, in certain cases, for search and seizure 15 without warrant; prescribing penalties and forfeitures; 16 providing for local option, and repealing existing laws," 17 further providing for special occasion permits. 18 The General Assembly of the Commonwealth of Pennsylvania 19 hereby enacts as follows: 20 Section 1. Section 408.4(a) and (c) of the act of April 12, 21 1951 (P.L.90, No.21), known as the Liquor Code, amended July 11, 22 1980 (P.L.558, No.117), are amended and subsections are added to 23 read: 24 Section 408.4. Special Occasion Permits.--(a) Upon 25 application of any hospital, church, synagogue, volunteer fire
1 company, bona fide sportsmen's club in existence for at least 2 ten years and upon payment of a fee of fifteen dollars ($15) per 3 day, the board shall issue a special occasion permit good for a 4 period of not more than three consecutive days. Special occasion 5 permits may also be issued to a museum operated by a nonprofit 6 corporation in a city of the third class or a nonprofit 7 corporation engaged in the performing arts in a city of the 8 third class for a period of not more than [six nonconsecutive] <-- 9 OR ten consecutive days at a fee of fifteen dollars ($15) per <-- 10 day. 11 * * * 12 (c) Such special occasion permit shall only be valid for the 13 number of days stated in the permit. Only one permit may be 14 issued to any permittee during the year. Provided, that a museum 15 operated by a nonprofit corporation in a city of the third class 16 and a nonprofit corporation engaged in the performing arts in a 17 city of the third class may be issued [no more than six permits <-- 18 during the year, each permit being valid for only one day. [The <-- 19 provisions of this subsection relating to the issuance of 20 permits for Bicentennial units shall expire December 31, 1976] 21 permits OR IN THE ALTERNATIVE, ONE PERMIT valid for no more than <-- 22 a total of ten consecutive days per year. 23 * * * 24 (d.1) The hours during which the holder of a special 25 occasion permit may sell liquor or malt or brewed beverages 26 shall be limited to the hours set forth in section 406 which are 27 applicable to hotel and restaurant licensees. THE HOURS DURING <-- 28 WHICH A NONPROFIT CORPORATION ENGAGED IN THE PERFORMING ARTS IN 29 A CITY OF THE THIRD CLASS MAY SELL LIQUOR OR MALT OR BREWED 30 BEVERAGES PURSUANT TO A SPECIAL OCCASION PERMIT SHALL BE LIMITED 19830S1034B1705 - 2 -
1 TO THOSE HOURS SET FORTH IN SECTION 408.3(G.1). 2 (d.2) At least forty-eight hours prior to the sale of any 3 liquor or malt or brewed beverages, the holder of a special 4 occasion permit shall notify the local police department, or in 5 the absence of a local police department, the Pennsylvania State 6 Police, of the times when and place where the sale of liquor or 7 malt or brewed beverages shall occur. 8 * * * 9 Section 2.
