                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," revising the authority for taxation
     6     of real estate in school districts of the first class or home
     7     rule school districts.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  The act of March 10, 1949 (P.L.30, No.14), known
    11  as the "Public School Code of 1949," is amended by adding a
    12  section to read:
    13     Section 652.2  Mandated Rate of Taxation.--Notwithstanding
    14  the provisions of the act of August 9, 1963 (P.L.643, No.341),
    15  known as the "First Class City Public Education Home Rule Act,"
    16  the city council of a city which is coterminous with a home rule
    17  school district established pursuant to the First Class City
    18  Public Education Home Rule Act, shall authorize and levy not
    19  less than thirty-five (35) mills on the dollar of the total
    20  assessment of all real estate assessed and certified for
    21  taxation in the territory constituting the district. Revenues

     1  raised pursuant to this section shall be used exclusively by the
     2  school district for the costs of education.
     3     Section 2.  It is the intent of the General Assembly that the
     4  city council reallocate its existing authorized millage between
     5  the city and the school district by transferring revenues
     6  presently raised for municipal purposes to the school district.
     7  It is the intent of the General Assembly that this act not
     8  authorize or require an increase in the total combined millage
     9  levied for municipal and school purposes on June 1, 1977.
    10     Section 3.  This act shall take effect immediately and shall
    11  apply to the fiscal year of a home rule school district
    12  commencing in l977.
