SENATE BILL

        AS REPORTED FROM COMMITTEE ON STATE GOVERNMENT, HOUSE OF
           REPRESENTATIVES, AS AMENDED, OCTOBER 20, 1999

                                     AN ACT

     1  Authorizing the Department of General Services, with the
     2     approval of the Governor, to grant and convey to Mercer
     3     County certain lands situate in Coolspring Township, Mercer
     4     County; AND AUTHORIZING THE DEPARTMENT OF GENERAL SERVICES,    <--
     5     WITH THE APPROVAL OF THE GOVERNOR, TO GRANT AND CONVEY TO THE
     6     CAPITAL REGION ECONOMIC DEVELOPMENT CORPORATION, A
     7     PENNSYLVANIA NONPROFIT CORPORATION, CERTAIN LANDS SITUATE IN
     8     THE CITY OF HARRISBURG, DAUPHIN COUNTY.

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  (A)  The Department of General Services, with the  <--
    12  approval of the Governor, is hereby authorized on behalf of the
    13  Commonwealth of Pennsylvania to grant and convey to Mercer
    14  County certain land and buildings described in section 2          <--
    15  SUBSECTION (B) for fair market value as determined by             <--
    16  independent appraisal.
    17     Section 2. (B)  The property to be conveyed pursuant to        <--
    18  section 1 SUBSECTION (A), known as Lot 1 of the Mercer State      <--
    19  Police Barracks Subdivision, consisting of approximately 0.85


     1  acres and a building bounded and more particularly described as
     2  follows:
     3     BEGINNING at a point in the centerline of S.R. 0058 at the
     4  northeast corner of the lot herein described; thence south 17
     5  degrees, 05 minutes east along the centerline of S.R. 0058 for a
     6  distance of 205.85 feet to a point; thence south 88 degrees, 45
     7  minutes west along lands now or formerly of Gitson for a
     8  distance of 215.32 feet to an iron pin; thence north 01 degree,
     9  28 minutes, 30 seconds west along Lot 2 of said subdivision for
    10  a distance of 198.04 feet to a mag nail; thence north 88
    11  degrees, 45 minutes east along Lot 2 of said subdivision for a
    12  distance of 159.93 feet to a point in the center line of S.R.
    13  0058, said point being the place of beginning for the above
    14  described parcel.
    15     Containing 0.85 acres.
    16     Section 3. (C)  The conveyance shall be made under and         <--
    17  subject to all lawful and enforceable easements, servitudes and
    18  rights of others, including but not confined to streets,
    19  roadways and rights of any telephone, telegraph, water,
    20  electric, gas or pipeline companies as well as under and subject
    21  to any lawful and enforceable estates or tenancies vested in
    22  third persons appearing of record, for any portion of the land
    23  or improvements erected thereon.
    24     Section 4. (D)  The deed of conveyance shall be by special     <--
    25  warranty deed and shall be executed by the Secretary of General
    26  Services in the name of the Commonwealth of Pennsylvania.
    27     Section 5. (E)  Costs and fees incidental to this conveyance   <--
    28  shall be borne by the Grantee.
    29     Section 6. (F)  In the event that this conveyance is not       <--
    30  executed within 12 months of the effective date of this act, the

     1  property may be disposed of in accordance with section 2406-A of
     2  the act of April 9, 1929 (P.L.177, No.175), known as The
     3  Administrative Code of 1929.
     4     SECTION 2.  (A)  THE DEPARTMENT OF GENERAL SERVICES, WITH THE  <--
     5  APPROVAL OF THE GOVERNOR, IS HEREBY AUTHORIZED ON BEHALF OF THE
     6  COMMONWEALTH OF PENNSYLVANIA TO GRANT AND CONVEY THE CAPITAL
     7  REGION ECONOMIC DEVELOPMENT CORPORATION CERTAIN LANDS AND A
     8  BUILDING DESCRIBED IN SUBSECTION (B) FOR FAIR MARKET VALUE AS
     9  DETERMINED BY INDEPENDENT APPRAISAL.
    10     (B)  THE PROPERTY TO BE CONVEYED PURSUANT TO SUBSECTION (A)
    11  CONSISTS OF APPROXIMATELY 2.339 ACRES OF LAND AND A BUILDING,
    12  LOCATED IN THE SEVENTH WARD OF THE CITY OF HARRISBURG, DAUPHIN
    13  COUNTY, BOUNDED AND MORE PARTICULARLY DESCRIBED AS FOLLOWS:
    14     BEGINNING AT AN IRON PIPE AT THE INTERSECTION OF THE WESTERLY
    15  RIGHT OF WAY LINE OF NORTH CAMERON STREET (80 FEET WIDE) AND THE
    16  SOUTHERLY RIGHT OF WAY LINE OF REILY STREET (80 FEET WIDE);
    17  THENCE ALONG THE WESTERLY RIGHT OF WAY LINE OF NORTH CAMERON
    18  STREET, SOUTH 10 DEGREES, 28 MINUTES, 16 SECONDS EAST, A
    19  DISTANCE OF 302.91 FEET TO A STEEL PIN; THENCE ALONG OTHER LANDS
    20  OF THE COMMONWEALTH OF PENNSYLVANIA (FORMERLY CALDER STREET) THE
    21  FOLLOWING FOUR (4) COURSES; (1) SOUTH 66 DEGREES, 20 MINUTES, 21
    22  SECONDS WEST, A DISTANCE OF 82.42 FEET TO A POINT; (2) BY A
    23  CURVE TO THE RIGHT, HAVING A RADIUS OF 480.00 FEET, AN ARC
    24  LENGTH OF 108.48 FEET, THE CHORD OF WHICH IS SOUTH 72 DEGREES,
    25  48 MINUTES, 49 SECONDS WEST, A DISTANCE OF 108.25 FEET TO A
    26  POINT; (3) SOUTH 79 DEGREES, 17 MINUTES, 16 SECONDS WEST, A
    27  DISTANCE OF 170.96 FEET TO A P.K. NAIL; (4) NORTH 10 DEGREES, 31
    28  MINUTES, 46 SECONDS WEST, A DISTANCE OF 246.18 FEET TO A STEEL
    29  REBAR, SAID STEEL REBAR BEING IN THE SOUTHERLY RIGHT OF WAY LINE
    30  OF REILY STREET; THENCE ALONG SAID SOUTHERLY RIGHT OF WAY LINE

     1  OF REILY STREET, NORTH 65 DEGREES, 37 MINUTES, 00 SECONDS EAST,
     2  A DISTANCE OF 369.81 FEET TO AN IRON PIPE, SAID IRON PIPE BEING
     3  IN THE WESTERLY RIGHT OF WAY LINE OF NORTH CAMERON STREET, THE
     4  POINT OF BEGINNING.
     5     CONTAINING 2.339-ACRES OF LAND.
     6     (C)  THE DEPARTMENT OF GENERAL SERVICES IS AUTHORIZED TO
     7  RESERVE A PERMANENT EASEMENT ON THE LANDS HEREIN CONVEYED OVER
     8  THE EXISTING DRIVEWAY (AKA CALDER STREET) FOR INGRESS, EGRESS
     9  AND REGRESS TO ITS RESIDUAL PROPERTY KNOWN AS 1400 NORTH CAMERON
    10  STREET.
    11     (D)  THE CONVEYANCE SHALL BE MADE UNDER AND SUBJECT TO ALL
    12  LAWFUL AND ENFORCEABLE EASEMENTS, SERVITUDES AND RIGHTS OF
    13  OTHERS, INCLUDING BUT NOT CONFINED TO STREETS, ROADWAYS AND
    14  RIGHTS OF ANY TELEPHONE, TELEGRAPH, WATER, ELECTRIC, GAS OR
    15  PIPELINE COMPANIES, AS WELL AS UNDER AND SUBJECT TO ANY LAWFUL
    16  AND ENFORCEABLE ESTATES OR TENANCIES VESTED IN THIRD PERSONS
    17  APPEARING OF RECORD, FOR ANY PORTION OF THE LAND OR IMPROVEMENTS
    18  ERECTED THEREON.
    19     (E)  THE DEED OF CONVEYANCE SHALL BE BY SPECIAL WARRANTY DEED
    20  AND SHALL BE EXECUTED BY THE SECRETARY OF GENERAL SERVICES IN
    21  THE NAME OF THE COMMONWEALTH OF PENNSYLVANIA.
    22     (F)  COSTS AND FEES INCIDENTAL TO THIS CONVEYANCE SHALL BE
    23  BORNE BY THE GRANTEE.
    24     Section 8 3.  This act shall take effect immediately.          <--
