AN ACT

  

1

Providing for the establishment and operation of the

2

Pennsylvania Law Enforcement Officer Alert System; and

3

imposing powers and duties on the Pennsylvania State Police

4

and the Department of Transportation.

The General Assembly of the Commonwealth of Pennsylvania

6

hereby enacts as follows:

Section 1.  Short title.

8

This act shall be known and may be cited as the Pennsylvania

9

Law Enforcement Officer Alert Law.

10

Section 2.  Definitions.

11

The following words and phrases when used in this act shall

12

have the meanings given to them in this section unless the

13

context clearly indicates otherwise:

14

"Alert system."  The Pennsylvania Law Enforcement Officer

15

Alert System which is established and operated by the

16

Pennsylvania State Police under section 3.

17

"Department."  The Department of Transportation of the

18

Commonwealth.

"Message board."  The electronic message system used by the

2

Department of Transportation to alert the motoring public to

3

changes in traffic conditions affecting State highways.

Section 3.  Alert system.

(a)  Establishment.--The Pennsylvania State Police shall

6

establish and operate the Pennsylvania Law Enforcement Officer

7

Alert System.

8

(b)  System components.--The alert system shall use the

9

electronic message boards of the department to request the

10

assistance of the motoring public in the provision of

11

information which will assist law enforcement authorities in the

12

apprehension of any perpetrator who assaults a law enforcement

13

officer, who wounds a law enforcement officer or kills a law

14

enforcement officer when that perpetrator is fleeing the crime

15

scene in a vehicle.

16

(c)  Information to be displayed.--The alert information

17

shall contain a description of the alleged perpetrator, a

18

description of the vehicle, the license plate number of the

19

vehicle, if available, and the party to be called if the

20

perpetrator is spotted.

Section 4.  Duties of the Pennsylvania State Police.

22

In addition to the duties under section 3, the Pennsylvania

23

State Police shall:

24

(1)  Coordinate with the department to provide for the

25

display of the information required under section 3.

26

(2)  Coordinate with local law enforcement authorities to

27

activate the alert system and provide for the exchange and

28

the display of necessary information.

29

Section 5.  Effective date.

30

This act shall take effect January 1, 2010.
