AN ACT 1 Amending Title 24 (Education) of the Pennsylvania Consolidated 2 Statutes, providing for a new period of eligibility for 3 special early retirement; and further providing for standards 4 of compensation for employees of the board. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Title 24 of the Pennsylvania Consolidated 8 Statutes is amended by adding a section to read: 9 § 8313. Eligibility for limited early retirement. 10 Notwithstanding any provisions of this title to the contrary, 11 the following early retirement provisions shall be applicable to 12 specified eligible members: 13 (1) Any member who, during the period of time from the 14 effective date of this section through July 10, 1998: 15 (i) has credit for at least 30 eligibility points; 16 (ii) terminates school service; and 17 (iii) files an application for retirement with an
1 effective date of retirement not later than July 11, 2 1998, 3 shall be entitled to receive a maximum single life annuity 4 calculated pursuant to section 8342 (relating to maximum 5 single life annuity) without any reduction by virtue of an 6 effective date of retirement which is under the 7 superannuation age. 8 (2) Any member who, during the period of time from April 9 1, 1999, through June 30, 1999: 10 (i) has credit for at least 30 eligibility points; 11 (ii) terminates school service; and 12 (iii) files an application for retirement with an 13 effective date of retirement not later than July 1, 1999, 14 shall be entitled to receive a maximum single life annuity 15 calculated pursuant to section 8342 without any reduction by 16 virtue of an effective date of retirement which is under the 17 superannuation age. 18 Section 2. Section 8502(a) of Title 24 is amended to read: 19 § 8502. Administrative duties of board. 20 (a) Employees.--The secretary, clerical and other employees 21 of the board and their successors whose positions on the 22 effective date of this part are under the classified service 23 provisions of the act of August 5, 1941 (P.L.752, No.286), known 24 as the Civil Service Act, shall continue under such provisions. 25 Notwithstanding any other provision of law, the compensation 26 [and classification shall be established by the board for the 27 secretary, the assistant secretary, investment professionals and 28 other professionals as designated by the board who are not 29 covered by a collective bargaining agreement.] of all officers 30 and employees of the board who are not covered by a collective 19970S0803B1819 - 2 -
