                                     AN ACT

     1  Amending the act of June 24, 1931 (P.L.1206, No.331), entitled
     2     "An act concerning townships of the first class; amending,
     3     revising, consolidating, and changing the law relating
     4     thereto," further regulating the filling of a vacancy in the
     5     office of commissioner.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 530, act of June 24, 1931 (P.L.1206,
     9  No.331), known as "The First Class Township Code," reenacted and
    10  amended May 27, 1949 (P.L.1955, No.569) and amended April 27,
    11  1967 (P.L.19, No.9), is amended to read:
    12     Section 530.  Township Commissioners.--When a vacancy occurs
    13  in the office of township commissioner in any township, by
    14  reason of death, resignation, removal from the township or ward,
    15  or otherwise, the board of township commissioners of such
    16  township shall fill such vacancy by appointing by resolution a
    17  registered voter of the ward or township, as the case may be, in
    18  which the vacancy occurs. If the board of township commissioners
    19  of any township shall refuse, fail, or neglect, or be unable for


     1  any reason whatsoever, to fill such vacancy within thirty (30)
     2  days after the vacancy occurs, then the court of [quarter
     3  sessions] common pleas shall upon the petition of twenty
     4  registered voters of the ward or township, as the case may be,
     5  in which the vacancy occurs appoint a registered voter of the
     6  township to fill the vacancy. In either event, the person so
     7  appointed shall hold the office if the term thereof continues so
     8  long, until the first Monday in January after the first
     9  municipal election occurring more than sixty (60) days after the
    10  vacancy occurs, at which election an eligible person shall be
    11  elected for the remainder of the term and shall have been a
    12  resident of the township continuously for at least one (1) year
    13  before his appointment [and shall hold office for the unexpired
    14  term of the person whose place he is appointed to fill]. In
    15  townships divided into wards, a commissioner appointed by either
    16  the board of commissioners or the court of [quarter sessions]
    17  common pleas shall reside in the ward in which the vacancy
    18  occurred and shall have resided in said ward continuously for at
    19  least one (1) year before his appointment.
