AN ACT
Prohibiting the mandatory COVID-19 vaccination of Pennsylvania
residents by the Commonwealth, political subdivisions or as a
condition of employment.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Short title.
This act shall be known and may be cited as the Medical
Freedom Act.
Section 2. Scope.
This act relates to limitations on COVID-19 vaccine
requirements.
Section 3. Findings and declarations.
The General Assembly finds and declares as follows:
(1) Every resident in this Commonwealth has the
inalienable right to bodily integrity and should be free from
any threat or compulsion that the individual must receive a
COVID-19 vaccination.
(2) An individual who exercises the right not to be

vaccinated or receive a pharmaceutical or any drug must not
be denied any right or privilege of citizenship.
(3) Currently this Commonwealth allows for medical and
religious exemptions for immunizations and these rights
should be given to all Pennsylvania residents who do not want
to receive an immunization, including, but not limited to, a
COVID-19 or SARS-CoV "vaccine," or to receive a
pharmaceutical or any drug.
Section 4. Prohibition.
The following apply:
(1) The Commonwealth or a political subdivision of the
Commonwealth, or an agent thereof, may not mandate an
individual in this Commonwealth to receive a COVID-19 or
other vaccination, including, but not limited to, a SARS-CoV
"vaccine," or to receive any pharmaceutical or drug.
(2) A State agency or political subdivision may not
enact or issue a rule, ordinance, order or any similar policy
that would result in an individual being required to submit
to or receive a COVID-19 or other vaccination, including, but
not limited to, a SARS-CoV "vaccine," or to receive any
pharmaceutical or drug.
(3) A State agency or political subdivision, or an agent
thereof, may not take an action which would result in an
individual being required to submit to or receive a COVID-19
or other vaccination, including, but not limited to, a SARS-
CoV "vaccine," or to receive any pharmaceutical or drug,
including as a condition of employment, access to education,
the ability to travel, entry to a public place or contracting
with a State agency or political subdivision.
(4) A COVID-19 or other vaccination, including, but not

limited to, a COVID-19 or SARS-CoV "vaccine," or any
pharmaceutical or drug, offered by the Commonwealth as part
of a mass vaccination or other effort may only be provided to
individuals who provide informed consent in writing to
receiving the vaccination, without coercion, after receiving
and being provided a copy in writing in paper format of full
information of all known ingredients, risks and benefits
prior to the COVID-19 or other vaccination, including, but
not limited to, a COVID-19 or SARS-CoV "vaccine," or any
pharmaceutical or drug.
(5) Employers are prohibited from taking any adverse
employment action against an individual who declines to
receive a COVID-19 or other vaccination, including, but not
limited to, a COVID-19 or SARS-CoV "vaccine," or any
pharmaceutical or drug, including, but not limited to,
discrimination, termination, suspension, involuntary
reassignment, unpaid leave, demotion, harassment, coercion or
retaliation. If an employer violates the provisions of this
paragraph, an aggrieved employee shall have the right to
apply for and receive unemployment benefits, as well as back
pay, front pay, lost wages, consequential damages, emotional
damages, court and litigation costs and attorney fees. If the
employer willfully and maliciously discriminates or commits a
violation under this paragraph it shall also be liable to the
employee for punitive damages in the treble amount of the
actual damages awarded.
(6) An individual may not be discriminated against or
denied entrance, service or the ability to purchase goods,
receive medical care or to participate for refusal to accept
a COVID-19 vaccination or other vaccination, including, but

not limited to, a COVID-19 or SARS-CoV "vaccine," or any
pharmaceutical or drug.
(7) A citizen may not be forced or coerced to sign a
COVID-19 vaccination declination waiver.
Section 5. Notice.
If the Commonwealth or a political subdivision, or an agent
thereof, recommends that an individual receive a COVID-19
vaccination or other vaccination, including, but not limited to,
a COVID-19 or SARS-CoV "vaccine," or any pharmaceutical or drug,
the official or entity shall provide notice that the
recommendation is not mandatory in each oral or written
statement made.
Section 6. Effective date.
This act shall take effect immediately.
