SENATE BILL

                                     AN ACT

     1  Amending the act of May 1, 1933 (P.L.103, No.69), entitled, as
     2     reenacted and amended, "An act concerning townships of the
     3     second class; and amending, revising, consolidating and
     4     changing the law relating thereto," further providing for
     5     county associations and for the State Association of Township
     6     Supervisors.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 1402 of the act of May 1, 1933 (P.L.103,
    10  No.69), known as The Second Class Township Code, reenacted and
    11  amended November 9, 1995 (P.L.350, No.60), is amended to read:
    12     Section 1402.  State Association of Township Supervisors
    13  Authorized.--(a)  The formation of a State Association of
    14  Township Supervisors is authorized.
    15     (b)  The State association shall hold annual meetings, at a
    16  time and place within this Commonwealth as it may designate, to
    17  discuss questions and subjects pertaining to the duties of
    18  elected and appointed township officials and the improvement of
    19  township government.


     1     (c)  The State association, at its annual meeting, by
     2  majority vote of all qualified voting delegates present, may
     3  adopt and amend bylaws to govern the State association. The
     4  bylaws shall govern the qualification of delegates, election of
     5  officers, their designation, qualifications and duties, payment
     6  of dues and other organizational matters. The State association
     7  shall function under the bylaws to advance the interest of
     8  township government.
     9     (d)  The board of supervisors may designate one or more of
    10  the following elected or appointed officials of the township to
    11  attend the annual meeting of the State association: supervisors,
    12  secretary, treasurer and manager. The convention shall be held
    13  in this Commonwealth under the procedures adopted by the State
    14  association.
    15     (e)  Each township with dues paid in the State association
    16  shall elect one of those delegates designated in subsection (d)
    17  to be the voting delegate at the convention.
    18     (f)  Each township shall certify the name and address of its
    19  delegate or delegates and the designated voting delegate to the
    20  State association at least thirty days before the opening of the
    21  State convention.
    22     (g)  (1)  The expenses allowed to the delegates attending the
    23  annual meeting are limited to the registration fee, mileage for
    24  use of a personal vehicle or reimbursement of actual
    25  transportation expense going to and returning from the meeting
    26  plus all other actual expenses that the board of supervisors
    27  agrees to pay. Every delegate attending the annual meeting shall
    28  submit to the board of supervisors an itemized account of
    29  expenses incurred at the meeting.
    30     (2)  The board of supervisors may authorize township employes

     1  to be compensated at their regular employe rate during their
     2  attendance at the annual meeting.
     3     (3)  In addition, the township board of supervisors may
     4  authorize nonemploye supervisors attending the annual meeting as
     5  delegates to receive thirty-five dollars per day for each day of
     6  attendance at the annual meeting.
     7     (4)  No delegate shall receive expenses for attending more
     8  than four days each year.
     9     (h)  Membership dues of the State association are legal
    10  expenses of the townships and shall be used for the payment of
    11  expenses incurred, including, but not limited to, the rental or
    12  acquisition of real estate to be used for State association
    13  purposes and activities, cost of publications, salaries, cost of
    14  services provided to or for townships and other expenses
    15  incurred on behalf of the State association.
    16     (i)  The State association may purchase, receive, lease as
    17  lessee, accept by gift or devise or otherwise acquire and own,
    18  use and otherwise deal with any real estate in its own name for
    19  association purposes and mortgage, sell and convey, lease as
    20  lessor and otherwise dispose of all or part of the real estate.
    21     Section 2.  This act shall take effect in 60 days.
