AN ACT 1 Amending the act of December 20, 1985 (P.L.457, No.112), 2 entitled "An act relating to the right to practice medicine 3 and surgery and the right to practice medically related acts; 4 reestablishing the State Board of Medical Education and 5 Licensure as the State Board of Medicine and providing for 6 its composition, powers and duties; providing for the 7 issuance of licenses and certificates and the suspension and 8 revocation of licenses and certificates; providing penalties; 9 and making repeals," further providing for standards for 10 medical training facilities. 11 The General Assembly of the Commonwealth of Pennsylvania 12 hereby enacts as follows: 13 Section 1. Section 23 of the act of December 20, 1985 14 (P.L.457, No.112), known as the Medical Practice Act of 1985, is 15 amended to read: 16 Section 23. Standards for medical training facilities. 17 (a) General rule.--The educational qualifications for 18 acceptance as a matriculant in a medical college or other 19 medical training facility incorporated within this Commonwealth
1 and the curricula and training to be offered by such medical 2 colleges or other medical training facility shall meet the 3 requirements set by the board and any accrediting body which may 4 be recognized by the board. Curriculum requirements under this 5 subsection shall mandate a minimum of 30 hours of study of 6 substance abuse. 7 (b) Duties of the board.--It shall be the duty of the board, 8 in its discretion, periodically to ascertain the character of 9 the instruction and the facilities possessed by each of the 10 medical colleges and other medical training facilities offering 11 or desiring to offer medical training in accordance with the 12 requirements of this act. It shall further be the duty of the 13 board, by inspection and/or otherwise, to ascertain the 14 facilities and qualifications of medical colleges and other 15 medical training facilities outside this Commonwealth, whose 16 graduates or trainees desire to obtain licensure, graduate 17 medical training or certification in this Commonwealth, provided 18 further that the board shall have the authority to refuse to 19 license graduates of any such medical institutions, colleges or 20 hospitals which in its judgment do not meet similar standards 21 for medical training and facilities as are required of medical 22 institutions in this Commonwealth. In enforcing this provision, 23 the board shall give due notice to any medical institution, 24 college or hospital upon which it has rendered a decision that 25 its training and facilities do not meet the standards required 26 by the board. 27 (c) Refusal of recognition.--In the event that the board 28 determines that a medical training facility has failed to 29 provide adequate facilities, curricula or training, the board 30 shall not recognize the education or degrees obtained from the 19890S0628B0670 - 2 -
