AN ACT

Amending the act of August 9, 1955 (P.L.323, No.130), entitled,

2

as amended, "An act relating to counties of the first, third,

3

fourth, fifth, sixth, seventh and eighth classes; amending,

4

revising, consolidating and changing the laws relating

5

thereto; relating to imposition of excise taxes by counties,

6

including authorizing imposition of an excise tax on the

7

rental of motor vehicles by counties of the first class; and

8

providing for regional renaissance initiatives," further

9

providing for qualifications of elected county officers and

10

for district attorney qualifications.

The General Assembly of the Commonwealth of Pennsylvania

12

hereby enacts as follows:

Section 1.  Section 413 of the act of August 9, 1955

14

(P.L.323, No.130), known as The County Code, amended June 16,

15

1972 (P.L.468, No.149), is amended to read:

16

Section 413.  Qualifications of Elected County Officers.--No

17

person shall be elected to any county office, except the office

18

of district attorney otherwise provided for by this act, unless

19

he shall be at least eighteen years of age, a citizen of the

20

United States and a resident of the county, and shall have

21

resided within the county for one year next preceding his

election and shall be registered to vote in the county he or she

2

is seeking to represent.

Section 2.  Section 1401(a) of the act, amended July 14, 2005

4

(P.L.312, No.57), is amended to read:

Section 1401.  District Attorney; Qualifications;

6

Eligibility; Compensation.--(a)  The district attorney shall be

7

a resident of the county, at least twenty-five years of age, and

8

a citizen of the United States, shall have been admitted to

9

practice as an attorney before the Supreme Court of this

10

Commonwealth for at least one year prior to taking the oath of

11

office and shall have resided in the county for which he is

12

elected or appointed for one year next preceding his election or

13

appointment and shall be registered to vote in the county he or

14

she is seeking to represent or is appointed.

Section 3.  The amendment of sections 413 and 1401(a) of the

17

act shall apply to elections occurring on or after the effective

18

date of this section.

Section 4.  This act shall take effect in 60 days.
