| AN ACT |
| |
1 | Amending Title 65 (Public Officers) of the Pennsylvania |
2 | Consolidated Statutes, in ethics standards and financial |
3 | disclosure, further providing for restricted activities. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Section 1103(f) of Title 65 of the Pennsylvania |
7 | Consolidated Statutes is amended to read: |
8 | § 1103. Restricted activities. |

10 | (f) Contract.--No public official or public employee or his |
11 | spouse or child or any business in which the person or his |
12 | spouse or child is associated shall enter into any contract |
13 | [valued at $500 or more] with the governmental body with which |
14 | the public official or public employee is associated or any |
15 | subcontract [valued at $500 or more] with any person who has |
16 | been awarded a contract with the governmental body with which |
17 | the public official or public employee is associated [unless the |
18 | contract has been awarded through an open and public process, |

1 | including prior public notice and subsequent public disclosure |
2 | of all proposals considered and contracts awarded. In such a |
3 | case, the public official or public employee shall not have any |
4 | supervisory or overall responsibility for the implementation or |
5 | administration of the contract]. Any contract or subcontract |
6 | made in violation of this subsection shall be voidable by a |
7 | court of competent jurisdiction if the suit is commenced within |
8 | 90 days of the making of the contract or subcontract. |

10 | Section 2. This act shall take effect in 60 days. |
