AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, further providing for additional parking
3 regulations relating to handicapped persons and severely
4 disabled veterans.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Section 3354(d) of Title 75 of the Pennsylvania
8 Consolidated Statutes is amended to read:
9 § 3354. Additional parking regulations.

11 (d) Handicapped persons and severely disabled veterans.--
12 (1) When a motor vehicle bearing a handicapped or
13 severely disabled veteran plate or displaying a handicapped
14 or severely disabled veteran parking placard as prescribed in
15 this title is being operated by or for the transportation of
16 the handicapped person or severely disabled veteran, the
17 driver shall be relieved of any liability for parking for a
18 period of 60 minutes in excess of the legal parking period
1 permitted by local authorities except where local ordinances 2 or police regulations provide for the accommodation of heavy 3 traffic during morning, afternoon or evening hours. 4 (2) At the request of any handicapped person or severely 5 disabled veteran, local authorities may erect on the highway 6 as close as possible to their place of residence [a sign or 7 signs] an official sign indicating that that place is 8 reserved for the handicapped person or severely disabled 9 veteran[, that no parking is allowed there by others, and 10 that any unauthorized person parking there shall be subject 11 to a fine]. 12 (3) (i) Except for persons parking vehicles lawfully 13 bearing a handicapped or severely disabled veteran 14 registration plate or displaying a handicapped or 15 severely disabled veteran parking placard when such 16 vehicles are being operated by or for the transportation 17 of a handicapped person or a severely disabled veteran, 18 no person shall park a vehicle on public or private 19 property in a parking space reserved for a handicapped 20 person or severely disabled veteran [which property has 21 been so posted in accordance with departmental 22 regulations which shall require a sign stating the 23 penalty amount indicated in subsection (f), a sign 24 indicating that vehicles in violation of the subsection 25 may be towed and require that signs be replaced when they 26 become either obsolete or missing with all costs to 27 replace the necessary signs to be borne by the persons 28 responsible for signing the particular location]. Any 29 vehicle which is unlawfully parked in a designated 30 handicapped parking area may be removed from that area by 19990S0348B0372 - 2 -
1 towing and may be reclaimed by the vehicle owner upon 2 payment of the towing costs. 3 (ii) Local authorities shall have the power and may, 4 by ordinance or resolution, authorize handicapped persons 5 and severely disabled veterans to issue statements to 6 violators or violating vehicles for violation of 7 subparagraph (i).
