AN ACT
1 Amending Title 24 (Education) of the Pennsylvania Consolidated
2 Statutes, further providing for disability annuities.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. Section 8344(b) of Title 24 of the Pennsylvania
6 Consolidated Statutes is amended to read:
7 § 8344. Disability annuities.

9 (b) Reduction on account of earned income.--Payments on
10 account of disability shall be reduced by that amount by which
11 the earned income of the annuitant, as reported in accordance
12 with section 8508(b) (relating to rights and duties of
13 annuitants) for the preceding year together with the disability
14 annuity payments for the year, exceeds the greater of $5,000 or
15 the last year's salary of the annuitant as a school employee,
16 indexed accordingly due to any cost-of-living adjustments to
17 insure that the annuitant does not suffer any reduction in his
1 annuity benefits, provided that the annuitant shall not receive
2 less than his member's annuity or the amount to which he may be
3 entitled under section 8342, whichever is greater.

5 Section 2. This act shall take effect immediately.
