SENATE BILL

No. 132 Session of 1989

                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," providing for nonvoting student
     6     representatives on school boards.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  The act of March 10, 1949 (P.L.30, No.14), known
    10  as the Public School Code of 1949, is amended by adding a
    11  section to read:
    12     Section 328.  Student Representatives.--(a)  In addition to
    13  the elected members, there may be two (2) student members on
    14  each board of school directors. They shall act in a nonvoting
    15  capacity and represent the students in all the schools of the
    16  district.
    17     (b)  The student members of the board of school directors
    18  shall be elected by the student government of each school
    19  through its regular election procedure. In school districts


     1  comprised of more than one senior high school, officers shall
     2  sit as a joint board of directors for the purpose of selecting
     3  the two (2) school board representatives.
     4     (c)  The student representatives shall have the following
     5  qualifications:
     6     (1)  One shall be a senior, that is any current twelfth
     7  grader in a secondary school.
     8     (2)  One shall be a junior, that is any current eleventh
     9  grader in a secondary school.
    10     (3)  They shall be familiar with the procedures of the board
    11  of school directors.
    12     (4)  They shall be able to express the views of students
    13  intelligently in an oral manner.
    14     (d)  The term of office of the student representatives shall
    15  be one academic year. The senior, after having finished his or
    16  her term, shall be replaced by the junior. The junior, before
    17  assuming the position as senior representative, shall undergo a
    18  vote of confidence. Vacancies shall be filled for unexpired
    19  terms in the same manner as the member was originally selected.
    20     (e)  The powers and duties of a student member of a board of
    21  school directors shall be:
    22     (1)  To advise his or her respective school board on matters
    23  concerning student activities and concerns.
    24     (2)  To report back to his or her student government on all
    25  policies of concern to students.
    26     (f)  The student members of a board of school directors may
    27  attend all public and nonpublic school board meetings but may be
    28  exempted from any part of a meeting dealing with teacher
    29  salaries or personnel.
    30     (g)  The first student representatives shall be elected

     1  during the academic year beginning in 1989.
     2     Section 2.  This act shall take effect in 60 days.
