AN ACT 1 Requiring the termination of certain agencies of State 2 Government under certain circumstances, creating a Leadership 3 Committee with certain powers and duties and imposing powers 4 and duties upon the Legislative Budget and Finance Committee. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Short title. 8 This act shall be known and may be cited as the "Sunset Act." 9 Section 2. Definitions. 10 The following words and phrases when used in this act shall 11 have, unless the context clearly indicates otherwise, the 12 meanings given to them in this section: 13 "Agency." Any statutory authority, agency, board, bureau, 14 commission, committee, council, department, division, office or 15 any similar unit of State Government. 16 "LEGISLATIVE BUDGET AND FINANCE COMMITTEE." THE COMMITTEE <-- 17 FORMED PURSUANT TO THE ACT OF AUGUST 4, 1959 (P.L.587, NO.195),
1 ENTITLED, AS AMENDED, "AN ACT CREATING AND ESTABLISHING THE
2 LEGISLATIVE BUDGET AND FINANCE COMMITTEE; PROVIDING FOR ITS
3 MEMBERSHIP; PRESCRIBING ITS POWERS, FUNCTIONS AND DUTIES;
4 PROVIDING FOR THE APPOINTMENT OF AN EXECUTIVE DIRECTOR AND OTHER
5 PERSONNEL, AND MAKING AN APPROPRIATION."
6 "Performance audit." A written report by the Legislative
7 Budget and Finance Committee evaluating the management and
8 performance of an agency based on the statistics on its
9 operations and carried out in accordance with the standards for
10 performance and financial compliance auditing developed by the
11 United States General Accounting Office. It shall determine
12 whether the agency:
13 (1) Is conducting authorized activities or programs in a
14 manner consistent with accomplishing the objectives intended
15 by the General Assembly.
16 (2) Is conducting programs and activities and expending
17 funds made available in a faithful, efficient, economical and
18 effective manner.
19 This report shall include, but not be limited to, the criteria
20 listed in section 5(d).
21 Section 3. Leadership Committee.
22 There is hereby created a joint committee of the General
23 Assembly to be known as the Leadership Committee. The Leadership
24 Committee shall be composed of the Speaker of the House of
25 Representatives, the President pro tempore of the Senate and the
26 Majority and Minority Leaders of the House of Representatives
27 and the Senate. The Speaker of the House of Representatives
28 shall serve as the temporary chairman of the committee until
29 such time as the committee shall elect a chairman. Members of
30 the Leadership Committee may designate alternates ALTERNATE <--

1 MEMBERS OF THEIR RESPECTIVE CHAMBERS who will have the same 2 powers and duties as regular members. 3 Section 4. Powers and duties of the Leadership Committee. 4 The committee shall have the power and its duty shall be: 5 (1) To direct and coordinate the implementation of the 6 sunset review procedure. 7 (2) To assign the responsibility for the review and 8 evaluation of each agency scheduled for such review and 9 evaluation under the provisions of this act to an appropriate 10 standing committee of the Senate or the House of 11 Representatives or to appropriate standing committees of both 12 houses who shall operate jointly to review and evaluate the 13 agency, if such joint operation is authorized by the rules of 14 the House and Senate. The assignments for review and 15 evaluation shall be made in January of the year in which the 16 agency is scheduled to be terminated. If any committee which 17 has been assigned an agency for review and evaluation fails 18 to complete its duties within a reasonable period of time as 19 determined by the Leadership Committee, it shall be 20 discharged from further review or consideration of the 21 agency. The Leadership Committee shall then reassign the 22 agency to another committee for review and evaluation 23 pursuant to this act. 24 (3) To utilize and assign the staff of the Legislative 25 Budget and Finance Committee, for the purpose of conducting 26 performance audits, which duty shall be the priority of the 27 Legislative Budget and Finance Committee. 28 (4) To authorize, if necessary, a postponement of the 29 review or termination of an agency for a period not exceeding 30 one year. 19810S0108B1457 - 3 -
1 Section 5. Evaluation and review. 2 (a) The standing committee designated by the Leadership 3 Committee shall develop a plan for the evaluation and review of 4 an agency in conjunction with the Legislative Budget and Finance 5 Committee and representatives of the agency being evaluated. 6 (b) The standing committee shall hold at least one public 7 hearing for each evaluation and review of an agency. At the 8 hearing, the highest ranking officer of the agency or an 9 individual appointed by him shall bear the burden to testify 10 concerning the need for continued existence of the agency. The 11 committee shall receive other testimony at the public hearing as 12 it shall deem appropriate. 13 (c) The standing committee shall elicit information in each 14 evaluation and review of an agency from the Office of the 15 Auditor General and the Offices of Budget and Administration as 16 to the financial efficiency of the agency being reviewed. The 17 committee may request and the agency, subject to termination 18 shall provide such information as the committee deems pertinent 19 to its evaluation and review. 20 (d) The standing committee shall make a determination in 21 each evaluation and review as to whether the agency shall be 22 continued, altered or terminated. The committee shall base its 23 determination on the following criteria: 24 (1) whether termination would significantly harm or 25 endanger the public health, safety or welfare; 26 (2) whether there is overlap or duplication of effort by 27 other agencies that permit the termination of the agency; 28 (3) whether there is a more economical way of 29 accomplishing the objectives of the agency; 30 (4) whether there is a demonstrated need, based on 19810S0108B1457 - 4 -
1 service to the public, for the continuing existence of the 2 agency; 3 (5) whether the operation of the agency has been in the 4 public interest; 5 (6) whether the agency has encouraged public 6 participation in the making of its rules and decisions or 7 whether the agency has permitted participation solely by the 8 persons it regulates; 9 (7) whether there is an alternate, less restrictive 10 method of providing the same services to the public; and 11 (8) such other criteria as may be established by the 12 standing committees. 13 (e) Such standing committees shall draft a report concerning 14 each evaluation and review, stating in that report their 15 findings, their determination as to whether the agency should be 16 continued, altered or terminated, AND the reasons for such a <-- 17 determination and TOGETHER WITH A DRAFT OF appropriate <-- 18 legislation to implement the committees' recommendations. The 19 report shall be available for public inspection in the Office of 20 the Chief Clerk SECRETARY of the Senate and of the CHIEF CLERK <-- 21 OF THE House of Representatives. The report shall be made to the 22 General Assembly on or before the first session day of September 23 of the year in which the agency in question is scheduled for 24 termination. ONCE THE REPORT IS RECEIVED BY EACH HOUSE, THE <-- 25 APPROPRIATE LEGISLATION SHALL BE INTRODUCED AND REFERRED TO A 26 STANDING COMMITTEE, IN KEEPING WITH THE RULES OF EACH HOUSE AND 27 BE ACTED ON ACCORDINGLY. 28 (f) On or before March 1 of the year in which the agency in 29 question is scheduled for termination, the standing committees 30 designated by the Leadership Committee as responsible for the 19810S0108B1457 - 5 -
1 evaluation and review of the agency shall receive:
2 (1) from the Legislative Budget and Finance Committee, a
3 performance audit; and
4 (2) from the Legislative Reference Bureau, a report
5 outlining all legislation, then in effect, pertaining to the
6 creation, operation, duties, powers and funding of the
7 agency.
8 Section 6. Termination of agencies.
9 (a) The following agencies together with their corresponding
10 statutory functions and duties shall terminate all activities
11 and shall go out of existence on December 31, 1983:
12 The Bicentennial Commission of Pennsylvania.
13 The Civil Service Commission. <--
14 The State Board of Examiners of Public Accountants.
15 The State Farm Products Show Commission.
16 The State Board of Examiners of Architects.
17 The Milk Marketing Board.
18 The State Board of Auctioneer Examiners.
19 The Pennsylvania Labor Relations Board.
20 The State Board of Barber Examiners.
21 The Pennsylvania Securities Commission.
22 The State Board of Cosmetology.
23 The State Board of Funeral Directors.
24 The State Real Estate Commission.
25 The State Registration Board for Professional Engineers.
26 The State Board of Landscape Architects.
27 The State Board of Motor Vehicle Manufacturers, Dealers and
28 Salesmen.

9 (d) The Governor shall not utilize a reorganization plan,
10 executive order, rule or regulation or comparable authority to
11 evade the provisions of this act. Any programs, activities or
12 functions of any agency, scheduled for termination, which are
13 transferred to another agency not scheduled for termination or
14 scheduled for termination at a later date, shall be subject to
15 sunset review at the date scheduled for the termination of the
16 transferor agency. Any programs, activities or functions, of any
17 agency scheduled for termination which are transferred to
18 another agency scheduled for termination at an earlier date,
19 shall be subject to sunset review at the date scheduled for
20 termination of the transferee agency.: Provided, however, That <--
21 HOWEVER, between the time at which the Legislative Budget and <--
22 Finance Committee submits its performance audit to the standing
23 committee and the standing committee makes its recommendation to
24 the General Assembly, the Governor shall not utilize a
25 reorganization plan, executive order, rule or regulation or
26 comparable authority to transfer any programs, activities or
27 functions of an agency being evaluated.
28 (e) The termination of any agency under this act shall serve
29 to terminate any advisory agency, whether created by statute or
30 administrative action, established for the primary purpose of

1 advising or assisting the terminated agency. 2 (f) Agencies terminated shall be given until June 30 of the 3 year following the one in which they are terminated to wind up 4 their affairs. During that period, the Governor may petition the 5 General Assembly for a review of the termination but the agency 6 shall be terminated unless the General Assembly passes a law to 7 the contrary. 8 (g) The terms of office of appointees of an agency 9 terminated under this act shall end on June 30 of the year 10 following termination. 11 Section 7. Reestablishment OR CONTINUATION of agencies. <-- 12 (A) Any agency scheduled for termination under this act, may <-- 13 be reestablished by the General Assembly, by legislation. Each 14 reestablishment AS PROVIDED IN THIS SUBSECTION OR CONTINUED AS <-- 15 PROVIDED IN SUBSECTION (B) shall be: 16 (1) for a period of six years unless otherwise specified 17 in the legislation and again be subject to evaluation, review 18 and termination as provided in the act; and 19 (2) BY LEGISLATION in a separate bill, in which no more <-- 20 than one agency shall be reestablished and such agency shall 21 be mentioned in the title of the bill. 22 (B) UNLESS LEGISLATION IS ENACTED PRIOR TO NOVEMBER 1, <-- 23 REESTABLISHING AN AGENCY AS PROVIDED IN SUBSECTION (A), THE 24 PRESIDING OFFICER OF EACH HOUSE SHALL CAUSE TO BE PLACED ON 25 THEIR RESPECTIVE CALENDARS FOR THE FIRST LEGISLATIVE DAY IN 26 NOVEMBER, THE QUESTION, IN THE FORM OF A RESOLUTION, OF WHETHER 27 AN AGENCY SCHEDULED FOR TERMINATION ON DECEMBER 31 OF THAT YEAR 28 SHALL BE CONTINUED. IF A MAJORITY OF THE MEMBERS ELECTED TO EACH 29 HOUSE APPROVE SUCH A RESOLUTION PRIOR TO THE SCHEDULED 30 TERMINATION DATE OF DECEMBER 31, THE AGENCY SHALL BE CONTINUED 19810S0108B1457 - 10 -
1 UNTIL THE NEXT REVIEW AND TERMINATION CYCLE SCHEDULED FOR SAID 2 AGENCY. 3 (C) ANY STATUTE WHICH TERMINATES OR REENACTS AN AGENCY SHALL 4 CONTROL OVER ANY PROCEDURE PRESCRIBED BY THIS ACT FOR THE 5 CONTINUATION OR TERMINATION OF AN AGENCY. NO STATUTE SHALL BE 6 DEEMED TO CONTINUE AN AGENCY BEYOND A TERMINATION DATE 7 ESTABLISHED FOR SAID AGENCY PURSUANT TO THIS ACT, UNLESS THE 8 STATUTE EXPRESSLY REENACTS THE AGENCY IN ITS PRESENT OR ALTERED 9 STATE. 10 Section 8. Newly created agencies. 11 A statutory agency created after January 1, 1981 shall be 12 scheduled for termination at the conclusion of the sixth year 13 following its creation unless otherwise specified by the General 14 Assembly at its creation. 15 Section 9. Termination procedures. 16 (a) Records and property of an agency shall be transferred 17 to the department of which it was a part, or if it was an 18 independent agency, to the Department of General Services for 19 appropriate disposal of property and retention of records. 20 (b) All appropriations to and funds of the agency not spent 21 or encumbered shall lapse when the existence of the agency ends. 22 No agency, prior to the date in a fiscal year on which it is 23 scheduled to be terminated, shall expend in excess of 50% of any 24 general appropriation, Federal augmentation, appropriation or 25 similar appropriation made to the agency for said fiscal year: 26 Provided, however, That the agency may utilize a portion of the 27 unexpended balance of said appropriations to conclude its 28 affairs. THE LEADERSHIP COMMITTEE SHALL HAVE THE ABILITY TO <-- 29 WAIVE THE RESTRICTIONS ON EXPENDITURES SET FORTH IN THIS 30 SECTION, UPON A SHOWING BY THE AGENCY OF EXCEPTIONAL 19810S0108B1457 - 11 -
1 CIRCUMSTANCES. 2 (c) The employment of all personnel of the terminated agency 3 shall be terminated: Provided, however, That this subsection 4 shall not be construed to prohibit the employees from applying 5 for and being employed by other agencies or departments to fill 6 job vacancies. 7 (d) Employees of agencies terminated under this act, who 8 have civil service status or who are covered by union contracts 9 shall fill any existing vacancies within the administrative 10 branch of State Government in their grade and position. If there 11 are more employees than vacant positions at the time of 12 termination, then such terminated employees shall receive 13 employment in the first vacancies that shall thereafter exist in 14 their grade and position. 15 Section 10. Causes of action; RIGHTS OF BONDHOLDERS. <-- 16 (A) The provisions of this act shall not affect any <-- 17 liability incurred or right accrued or vested or affect any suit 18 pending or to be instituted to enforce any right under the 19 authority of any act or part thereof repealed by this act. 20 (B) THE PROVISIONS OF THIS ACT SHALL NOT AFFECT ANY RIGHTS <-- 21 OR DUTIES WITH RESPECT TO BONDHOLDERS, OF AN AGENCY SCHEDULED TO 22 BE TERMINATED. 23 Section 11. Access to records and witnesses. 24 The Legislative Budget and Finance Committee and its 25 authorized representative shall, for the purpose of examination 26 and audit authorized by this act, have ready access to persons 27 and may examine and copy to the extent deemed necessary to its 28 evaluation and review, pertinent records, accounts, papers, 29 reports, vouchers, correspondence, books and other documentation 30 of any Commonwealth agency. 19810S0108B1457 - 12 -
1 Section 12. Authority to administer oaths, subpoena witnesses 2 and records and take depositions. 3 For the purpose of this act, the Legislative Budget and 4 Finance Committee, with the concurrent resolution of both Houses 5 shall have the power to compel the attendance of witnesses and 6 the production of any papers, books, accounts and documents to 7 subpoena witnesses, take testimony under oath; to cause the 8 deposition of witnesses, residing within or without the 9 Commonwealth, to be taken in the manner prescribed by law and to 10 assemble records and documents, by subpoena or otherwise, with 11 the same power and authority as courts of record and may apply 12 to courts of record for the enforcement of these powers. 13 Any person who willfully neglects or refuses to comply with 14 any subpoena issued in behalf of the Legislative Budget and 15 Finance Committee, or refuses to testify to any matters 16 regarding which he may be lawfully interrogated, shall be 17 subject to the penalties provided by the laws of the 18 Commonwealth of Pennsylvania. 19 Section 13. General repeal. 20 All acts or parts of acts inconsistent with the provisions of 21 this act are repealed to the extent of the inconsistency. 22 Section 14. Expiration. 23 Unless the provisions of this section shall be repealed or 24 amended by the General Assembly, the provisions of this act 25 shall expire at the end of ten years from the effective date of 26 this act. 27 Section 15.
