SENATE RESOLUTION

No. 99 Session of 1989


        INTRODUCED BY GREENWOOD, PETERSON, MADIGAN, LEMMOND, LEWIS,
           ANDREZESKI, BAKER AND REIBMAN, JULY 7, 1989

        REFERRED TO INTERGOVERNMENTAL AFFAIRS, JULY 7, 1989

                            A CONCURRENT RESOLUTION

     1  Urging the Governor to take action against the State of New York
     2     for imposing unfair taxation upon residents of Pennsylvania.

     3     WHEREAS, The State of New York has amended its state income
     4  tax law to impose increased rates of taxation on the residents
     5  of other states who earn wages in New York; and
     6     WHEREAS, Thousands of Pennsylvania residents are now being
     7  taxed by New York at rates that reflect all of their income,
     8  without regard to how it is earned and without regard to whether
     9  that income was earned under the protection of the laws of New
    10  York; and
    11     WHEREAS, This new tax scheme has resulted in the taxation of
    12  Pennsylvanians who work in New York at rates entirely
    13  disproportionate to the services they consume or the benefits
    14  they receive from the State of New York; and
    15     WHEREAS, This tax increase is a grossly unfair and
    16  inequitable attempt to balance New York's state budget on the
    17  backs of thousands of commuters from Pennsylvania, New Jersey


     1  and Connecticut; and
     2     WHEREAS, Pennsylvania must respond with whatever legal means
     3  are available to this extraordinarily callous and devious move
     4  by the State of New York; therefore be it
     5     RESOLVED (the House of Representatives concurring), That the
     6  General Assembly urge the Governor to pursue with the utmost
     7  determination all means available for alleviating this
     8  inequitable tax, including, but not limited to, legal challenge
     9  of New York's action and proposing and endorsing retaliatory
    10  legislation against New York residents who work in Pennsylvania;
    11  and be it further
    12     RESOLVED, That copies of this resolution shall be transmitted
    13  to the Governor of the Commonwealth of Pennsylvania, the
    14  Governor of the State of New York, the President of the Senate
    15  of the State of New York and the Speaker of the Assembly of the
    16  State of New York.
