AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, further providing for antique and classic motor 3 vehicles; providing for pioneer, production and vintage motor 4 vehicles; and providing for an annual fee for personal 5 registration plates. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. The definitions of "antique motor vehicle" and 9 "classic motor vehicle" in section 102 of Title 75 of the 10 Pennsylvania Consolidated Statutes are amended and the section 11 is amended by adding definitions to read: 12 § 102. Definitions. 13 Subject to additional definitions contained in subsequent 14 provisions of this title which are applicable to specific 15 provisions of this title, the following words and phrases when 16 used in this title shall have, unless the context clearly 17 indicates otherwise, the meanings given to them in this section: 18 * * * 19 "Antique motor vehicle." A motor vehicle, but not a
1 reproduction thereof, manufactured in 1936 or thereafter and 2 more than 25 years prior to the current year which has been 3 maintained in or restored to a condition which is substantially 4 in conformance with manufacturer specifications and appearance. 5 * * * 6 "Classic motor vehicle." A motor vehicle, but not a 7 reproduction thereof, [manufactured at least 15 years prior to 8 the current year] which is included on the list of milestones or 9 classic cars published by the Milestone Car Society or the 10 Classic Car Club of America and which has been maintained in or 11 restored to a condition which is substantially in conformity 12 with manufacturer specifications and appearance. [Any classic 13 motor vehicle registered under section 1340 (relating to antique 14 and classic plates) on the effective date of the amendment to 15 this definition which fails to qualify as a classic motor 16 vehicle pursuant to these provisions may retain such classic 17 registration unless another type of registration is applied for 18 and issued for the vehicle.] 19 * * * 20 "Pioneer motor vehicle." A motor vehicle, but not a 21 reproduction thereof, manufactured before 1916 which has been 22 maintained in or restored to a condition which is substantially 23 in conformity with manufacturer specifications and appearance. 24 * * * 25 "Production motor vehicle." A motor vehicle, but not a 26 reproduction thereof, manufactured more than ten years prior to 27 the current year, which has been maintained in or restored to a 28 condition which is substantially in conformity with manufacturer 29 specifications and appearance. 30 * * * 19970S0096B0094 - 2 -
1 "Vintage motor vehicle." A motor vehicle, but not a 2 reproduction thereof, manufactured after 1915 and before 1936 3 which has been maintained in or restored to a condition which is 4 substantially in conformance with manufacturer specifications 5 and appearance. 6 * * * 7 Section 2. Section 1307(e) of Title 75 is repealed. 8 Section 3. Sections 1340, 1923, 1931, 4303(e) and 9 4703(b)(10) of Title 75 are amended to read: 10 § 1340. Antique, classic [and], collectible, pioneer, 11 production and vintage plates. 12 (a) General rule.--Upon submission by a vehicle owner of 13 information satisfactory to the department that a motorcycle or 14 motor vehicle is an antique, classic, collectible, pioneer, 15 production or vintage motorcycle or motor vehicle [or classic 16 motorcycle or motor vehicle or collectible motorcycle or motor 17 vehicle], accompanied by the appropriate initial registration 18 fee, the department may issue a special [plates] plate for the 19 motorcycle or vehicle. The applicant shall provide photographic 20 proof in a manner specified by the department to demonstrate the 21 condition of the motor vehicle. No annual registration fee may 22 be charged for antique, [collectible or classic] classic, 23 collectible, pioneer, production or vintage motorcycles or motor 24 vehicles. 25 (b) Use of plates.--It is unlawful for any person to operate 26 a motorcycle or vehicle with antique, [classic or collectible] 27 classic, collectible, pioneer, production or vintage 28 registration plates for general daily transportation. Permitted 29 use shall be limited to participation in club activities, 30 exhibits, tours, parades, occasional transportation and similar 19970S0096B0094 - 3 -
1 uses. Occasional transportation shall mean no more than one day 2 per week. 3 (c) Pioneer plate.--A pioneer plate shall be made of blue 4 and white porcelain and resemble the 1910 registration plate. 5 (d) Vintage plate.--The color of the vintage plate shall be 6 two-tone green. 7 (e) Classic motor vehicle registration.--A motor vehicle 8 registered as a classic motor vehicle on the effective date of 9 this subsection may continue to be registered as a classic motor 10 vehicle, regardless of whether it is included on the list of 11 milestone or classic cars published by the Milestone Car Society 12 or the Classic Car Club of America, unless another type of 13 registration is applied for and issued for the vehicle. 14 § 1923. Antique, classic [and collectible], collectible, 15 pioneer, production or vintage vehicles. 16 (a) Antique, classic, collectible and vintage motor 17 vehicles.--The fee for registration of an antique, classic [or 18 collectible], collectible or vintage motor vehicle shall be $50. 19 (b) Pioneer motor vehicles.--The fee for initial annual 20 registration of a pioneer motor vehicle shall be $75. 21 (c) Production motor vehicles.--The fee for issuance of a 22 production motor vehicle plate shall be $20 which shall be in 23 addition to the annual registration fee appropriate for the 24 vehicle type. The issuance fee shall be charged for each 25 production vehicle registration plate issued or replaced. 26 § 1931. Personal registration plates. 27 The fee for issuance of a personal registration plate shall 28 be $20 which shall be in addition to the annual registration 29 fee. [Only one payment of the issuance fee shall be charged for 30 each personal registration issued or replaced.] The annual fee 19970S0096B0094 - 4 -
1 to retain use of the personal registration plate shall be $10 2 which shall be in addition to the annual registration fee 3 permitted under this title. 4 § 4303. General lighting requirements. 5 * * * 6 (e) Equipment exempted by regulation.--Antique, classic, 7 pioneer and vintage motor vehicles, animal-drawn vehicles, 8 implements of husbandry, commercial implements of husbandry and 9 special mobile equipment, if operated exclusively between the 10 hours of sunrise and sunset and not during periods of reduced 11 visibility or insufficient illumination, may be exempted from 12 certain lighting equipment requirements of this part by 13 regulations of the department. 14 § 4703. Operation of vehicle without official certificate of 15 inspection. 16 * * * 17 (b) Exceptions.--Subsection (a) does not apply to: 18 * * * 19 (10) Antique, classic, pioneer and vintage motor 20 vehicles. 21 * * * 22 Section 4.
