| AN ACT |
| |
1 | Amending the act of December 15, 1982 (P.L.1266, No.287), |
2 | entitled, as amended, "An act conferring limited residency |
3 | status on military personnel, their dependents and civilian |
4 | personnel assigned to an active duty station in |
5 | Pennsylvania," expanding applicability of the act to include |
6 | all active duty personnel and their dependents. |
7 | The General Assembly of the Commonwealth of Pennsylvania |
8 | hereby enacts as follows: |
9 | Section 1. Section 1(a) of the act of December 15, 1982 |
10 | (P.L.1266, No.287), entitled, as amended, "An act conferring |
11 | limited residency status on military personnel, their dependents |
12 | and civilian personnel assigned to an active duty station in |
13 | Pennsylvania," amended June 28, 1996 (P.L.420, No.60), is |
14 | amended to read: |
15 | Section 1. (a) General rule.--The term "resident" or |
16 | "residency," or any other term or expression used to designate a |
17 | Commonwealth resident student, when used to determine the rate |

1 | of tuition to be charged students attending community colleges, |
2 | State-related and State-owned institutions of higher learning |
3 | shall be construed to mean and include any military personnel or |
4 | their dependents who are assigned to an active duty station in |
5 | Pennsylvania and who reside in Pennsylvania and any civilian |
6 | personnel or their dependents employed at a Department of |
7 | Defense facility who are transferred to Pennsylvania by the |
8 | Department of Defense and who reside in Pennsylvania. Military |
9 | personnel and their dependents and civilian personnel and their |
10 | dependents who are admitted to a community college or a State- |
11 | related or State-owned institution shall be charged resident |
12 | tuition rates provided that the student is a resident under this |
13 | section on the first day of the semester or term of the college |
14 | or institution. A community college, State-related or State- |
15 | owned institution of higher learning may charge resident tuition |
16 | rates to any active military personnel, their spouses or and | <-- |
17 | their dependents who are taking college courses or receiving |
18 | other education services through the Internet or by other |
19 | electronic means. |
