AN ACT
1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2 Consolidated Statutes, providing for sentencing of persons
3 who commit more than two rapes.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Title 18, act of November 25, 1970 (P.L.707,
7 No.230), known as the Pennsylvania Consolidated Statutes, is
8 amended by adding a section to read:
9 § 1356.1. Sentencing for persons with more than two
10 convictions of rape.
11 (a) Minimum sentence.--Anyone who pleads guilty or is
12 convicted of rape more than two times shall be sentenced to
13 imprisonment for no less than 40 years.
14 (b) Life imprisonment.--A court or jury may impose life
15 imprisonment on any person who has been convicted of more than
16 two rapes where:
17 (1) the victim was severely beaten;
18 (2) the victim was stabbed; or
1 (3) the victim was shot.
2 (c) Exception.--The provisions of section 1356 (relating to
3 sentence of total confinement) shall have no applicability to
4 this section.
5 Section 2. This act shall take effect in 60 days.
