                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, exempting ambulance services, emergency medical
     3     technicians and volunteer fire companies from the cost
     4     containment provisions for vehicle security.

     5     In recognition of the unselfish dedication of volunteer
     6  emergency response units in responding to the public need for
     7  such services to victims of motor vehicle accidents, and
     8  further, in recognition of the fact that the medicare fee
     9  schedule does not identify and provide for the fair and
    10  equitable compensation of such volunteer emergency response
    11  units, the purpose of this legislation is to cure a significant
    12  inequity and defect in the customary charge provision of 75
    13  Pa.C.S. Ch. 17, known as the Motor Vehicle Financial
    14  Responsibility Law.
    15     The General Assembly of the Commonwealth of Pennsylvania
    16  hereby enacts as follows:
    17     Section 1.  Section 1797 of Title 75 of the Pennsylvania

     1  Consolidated Statutes, amended February 7, 1990 (P.L.11, No.6),
     2  is amended by adding a subsection to read:
     3  § 1797.  Customary charges for treatment.
     4     * * *
     5     (d)  Exemption.--The provisions of this section shall not
     6  apply to charges or fees levied or assessed by providers of
     7  ambulance services, emergency medical technician services or
     8  volunteer fire company services.
     9     Section 2.  This act shall take effect immediately.
