AN ACT 1 Authorizing and directing the Department of Military Affairs, 2 the Department of General Services, the Department of 3 Environmental Resources and the Department of Public Welfare 4 to transfer jurisdiction within the State government of 5 certain tracts of Commonwealth real property acquired under 6 the act of September 29, 1938 (Sp.Sess., P.L.53, No.21), 7 entitled, as reenacted and amended, "An act relating to 8 institutions of counties, cities, wards, boroughs, townships, 9 institution districts and other political subdivisions, for 10 the care, maintenance, and treatment of mental patients; 11 providing for the transfer to the Commonwealth for the care, 12 maintenance and treatment of mental patients of such 13 institutions, and all grounds, lands, buildings and personal 14 property of such political subdivisions used for the care and 15 maintenance of indigent persons connected with such mental 16 institutions; providing for the management and operation or 17 closing and abandonment thereof; and the maintenance of 18 mental patients therein; including the collection of 19 maintenance in certain cases; providing for the retransfer of 20 certain property to counties, cities, wards, boroughs, 21 townships, institution districts and other political 22 subdivisions under certain circumstances; conferring and 23 imposing upon the Governor, the Department of Welfare, the 24 courts of common pleas and counties, cities, wards, boroughs, 25 townships, institution districts and other political 26 subdivisions certain powers and duties; prohibiting cities, 27 counties, wards, boroughs, townships, institution districts 28 and other political subdivisions from maintaining and 29 operating institutions, in whole or in part, for the care and 30 treatment of mental patients; and repealing inconsistent 31 laws," transferring certain parcels of land on former Byberry 32 State Hospital among the Department of Public Welfare, the
1 Department of General Services and the Department of 2 Environmental Resources. 3 WHEREAS, The site of Byberry State Hospital in northeast 4 Philadelphia was acquired around 1900 by the City of 5 Philadelphia, and a mental hospital was erected and operated 6 there; and 7 WHEREAS, The act of September 29, 1938 (Sp.Sess., P.L.53, 8 No.21), entitled, as reenacted and amended, "An act relating to 9 institutions of counties, cities, wards, boroughs, townships, 10 institution districts and other political subdivisions, for the 11 care, maintenance, and treatment of mental patients; providing 12 for the transfer to the Commonwealth for the care, maintenance 13 and treatment of mental patients of such institutions, and all 14 grounds, lands, buildings and personal property of such 15 political subdivisions used for the care and maintenance of 16 indigent persons connected with such mental institutions; 17 providing for the management and operation or closing and 18 abandonment thereof; and the maintenance of mental patients 19 therein; including the collection of maintenance in certain 20 cases; providing for the retransfer of certain property to 21 counties, cities, wards, boroughs, townships, institution 22 districts and other political subdivisions under certain 23 circumstances; conferring and imposing upon the Governor, the 24 Department of Welfare, the courts of common pleas and counties, 25 cities, wards, boroughs, townships, institution districts and 26 other political subdivisions certain powers and duties; 27 prohibiting cities, counties, wards, boroughs, townships, 28 institution districts and other political subdivisions from 29 maintaining and operating institutions, in whole or in part, for 30 the care and treatment of mental patients; and repealing 19940H2861B4437 - 2 -
1 inconsistent laws," transferred the real estate and personal 2 property used for the care, maintenance and treatment of mental 3 patients from the City of Philadelphia to the Commonwealth of 4 Pennsylvania. That act contained a reversion of title to the 5 City of Philadelphia in the event the property was abandoned or 6 not substantially improved by the Commonwealth. No consideration 7 was paid to the city for this property; and 8 WHEREAS, The Commonwealth has ceased using all the facilities 9 at Byberry State Hospital for care, maintenance or treatment of 10 mental illness; and 11 WHEREAS, The Commonwealth desires to reallocate finally the 12 land no longer used for care, maintenance or treatment of mental 13 illness; and 14 WHEREAS, The jurisdiction, duties and responsibilities for 15 the parcel described below were assigned to the Department of 16 Environmental Resources through the act of December 22, 1975 17 (P.L.606, No.175), entitled "An act authorizing and directing 18 the Department of General Services, or such department and The 19 General State Authority, to convey to Philadelphia or transfer 20 jurisdiction within the State government of certain tracts of 21 Commonwealth real property acquired under the act of September 22 29, 1938 (Sp. Sess., P.L.53, No.21), entitled, as reenacted and 23 amended, 'An act relating to institutions of counties, cities, 24 wards, boroughs, townships, institution districts and other 25 political subdivisions, for the care, maintenance, and treatment 26 of mental patients; providing for the transfer to the 27 Commonwealth for the care, maintenance and treatment of mental 28 patients of such institutions, and all grounds, lands, buildings 29 and personal property of such political subdivisions used for 30 the care and maintenance of indigent persons connected with such 19940H2861B4437 - 3 -
1 mental institutions; providing for the management and operation 2 or closing and abandonment thereof; and the maintenance of 3 mental patients therein; including the collection of maintenance 4 in certain cases; providing for the retransfer of certain 5 property to counties, cities, wards, boroughs, townships, 6 institution districts and other political subdivisions under 7 certain circumstances; conferring and imposing upon the 8 Governor, the Department of Welfare, the courts of common pleas 9 and counties, cities, wards, boroughs, townships, institution 10 districts and other political subdivisions certain powers and 11 duties; prohibiting cities, counties, wards, boroughs, 12 townships, institution districts and other political 13 subdivisions from maintaining and operating institutions, in 14 whole or in part, for the care and treatment of mental patients; 15 and repealing inconsistent laws,' imposing powers and duties on 16 the Department of Environmental Resources in connection with one 17 such tract, and providing for use of land conveyed to the City 18 of Philadelphia"; and 19 WHEREAS, The Commonwealth desires to construct a veterans 20 nursing home on the northeast corner of Roosevelt Boulevard and 21 Southampton Road on grounds now part of Benjamin Rush State Park 22 herein conveyed to the Department of Military Affairs; and 23 WHEREAS, The Commonwealth is further committed to the 24 development of Benjamin Rush State Park as a recreational 25 facility and nature preserve to benefit the residents of 26 southeast Pennsylvania and the newly created Veterans home, and 27 the Department of Environmental Resources is herein granted 28 ground for a permanent entrance to the park from Southampton 29 Road with the expectation that the new entrance will be 30 constructed as soon as practicable with funding provided by the 19940H2861B4437 - 4 -
1 act of December 18, 1980, entitled "A supplement to the act of 2 October 6, 1980 (No.145), entitled 'An act providing for the 3 capital budget for the fiscal year 1980-1981,' itemizing public 4 improvement and furniture and equipment projects, to be 5 constructed by the Department of General Services and 6 transportation assistance projects to be acquired or constructed 7 by the Pennsylvania Department of Transportation together with 8 their estimated financial cost; authorizing the incurring of 9 debt without the approval of the electors for the purpose of 10 financing the projects to be constructed by the Department of 11 General Services or Department of Transportation, stating the 12 estimated useful life of the projects; providing for the 13 adoption of capital projects to be financed from current 14 revenues of the Boating Fund and the Fish Fund and making an 15 appropriation." 16 The General Assembly of the Commonwealth of Pennsylvania 17 hereby enacts as follows: 18 Section 1. (a) The Department of General Services, with the 19 approval of the Governor and the Department of Public Welfare, 20 is hereby authorized and directed on behalf of the Commonwealth 21 of Pennsylvania to transfer the control and jurisdiction over 22 the following parcel of land situate in the City of 23 Philadelphia, Commonwealth of Pennsylvania, to the Department of 24 Environmental Resources, such land being bounded and described 25 as follows: 26 All that certain lot or piece of ground situate in the 58th 27 Ward of the City of Philadelphia and derived from a plan by 28 Vincent J. Nero, Registered Professional Engineer-Surveyor, 29 dated November 26, 1991, as follows (subject to an official 30 survey): 19940H2861B4437 - 5 -

1 north 80 degrees 29 minutes 40 seconds east, the distance of 2 70.792 feet to a point; (33) south 82 degrees 30 minutes 35 3 seconds east, the distance of 27.402 feet to the first mentioned 4 point and place of beginning. 5 Containing in total area 21.500 acres. 6 (b) The Department of General Services, with the approval of 7 the Governor and the Department of Environmental Resources, is 8 hereby authorized and directed on behalf of the Commonwealth of 9 Pennsylvania to transfer the control and jurisdiction over the 10 following parcel of land situate in the City of Philadelphia, 11 Commonwealth of Pennsylvania, TO THE DEPARTMENT OF GENERAL <-- 12 SERVICES, SUCH LAND BEING bounded and described as follows: 13 Beginning at a point of curve on the northeasterly side of 14 Southampton-Byberry Road (70 feet wide), said point being the 15 southeasterly end of a curve; having a radius of 25.000 feet and 16 an arc distance of 37.789 feet, connecting the northeasterly 17 side of said Southampton-Byberry Road and the southeasterly side 18 of Roosevelt Boulevard (254 feet wide - S.R.0001); thence 19 extending from said beginning point in northwesterly and 20 northeasterly directions on the said curved line bearing to the 21 right having a radius of 25.000 feet and an arc distance of 22 37.789 feet to a point of tangency on the southeasterly side of 23 the said Roosevelt Boulevard; thence extending north along the 24 southeasterly side of the said Roosevelt Boulevard, the distance 25 of 1,265.000 feet to a point on the southeasterly side of the 26 said Roosevelt Boulevard; thence extending in an eastwardly 27 direction 1,330.000 feet to a point; thence extending south a 28 distance of 675 feet more or less to a point on the south side 29 of East Bucks Drive; thence extending in a westwardly direction 30 the distance of 745 feet more or less to a point on the east 19940H2861B4437 - 9 -

11 Containing in area 7.2000 acres more or less.
12 (c) The responsibilities required of the Department of
13 Environmental Resources for managing this parcel 7.2-ACRE PARCEL <--
14 AS DESCRIBED IN SUBSECTION (B) in accordance with the act of
15 December 22, 1975 (P.L.606, No.175), entitled "An act
16 authorizing and directing the Department of General Services, or
17 such department and The General State Authority, to convey to
18 Philadelphia or transfer jurisdiction within the State
19 government of certain tracts of Commonwealth real property
20 acquired under the act of September 29, 1938 (Sp. Sess., P.L.53,
21 No.21), entitled, as reenacted and amended, 'An act relating to
22 institutions of counties, cities, wards, boroughs, townships,
23 institution districts and other political subdivisions, for the
24 care, maintenance, and treatment of mental patients; providing
25 for the transfer to the Commonwealth for the care, maintenance
26 and treatment of mental patients of such institutions, and all
27 grounds, lands, buildings and personal property of such
28 political subdivisions used for the care and maintenance of
29 indigent persons connected with such mental institutions;
30 providing for the management and operation or closing and

1 abandonment thereof; and the maintenance of mental patients 2 therein; including the collection of maintenance in certain 3 cases; providing for the retransfer of certain property to 4 counties, cities, wards, boroughs, townships, institution 5 districts and other political subdivisions under certain 6 circumstances; conferring and imposing upon the Governor, the 7 Department of Welfare, the courts of common pleas and counties, 8 cities, wards, boroughs, townships, institution districts and 9 other political subdivisions certain powers and duties; 10 prohibiting cities, counties, wards, boroughs, townships, 11 institution districts and other political subdivisions from 12 maintaining and operating institutions, in whole or in part, for 13 the care and treatment of mental patients; and repealing 14 inconsistent laws,' imposing powers and duties on the Department 15 of Environmental Resources in connection with one such tract, 16 and providing for use of land conveyed to the City of 17 Philadelphia," shall cease. 18 (d) The above described tracts and parcels of land are a 19 part of the same land vested in the Commonwealth of Pennsylvania 20 by the act of September 29, 1938 (Sp.Sess., P.L.53, No.21), 21 entitled, as reenacted and amended, "An act relating to 22 institutions of counties, cities, wards, boroughs, townships, 23 institution districts and other political subdivisions, for the 24 care, maintenance, and treatment of mental patients; providing 25 for the transfer to the Commonwealth for the care, maintenance 26 and treatment of mental patients of such institutions, and all 27 grounds, lands, buildings and personal property of such 28 political subdivisions used for the care and maintenance of 29 indigent persons connected with such mental institutions; 30 providing for the management and operation or closing and 19940H2861B4437 - 12 -
1 abandonment thereof; and the maintenance of mental patients 2 therein; including the collection of maintenance in certain 3 cases; providing for the retransfer of certain property to 4 counties, cities, wards, boroughs, townships, institution 5 districts and other political subdivisions under certain 6 circumstances; conferring and imposing upon the Governor, the 7 Department of Welfare, the courts of common pleas and counties, 8 cities, wards, boroughs, townships, institution districts and 9 other political subdivisions certain powers and duties; 10 prohibiting cities, counties, wards, boroughs, townships, 11 institution districts and other political subdivisions from 12 maintaining and operating institutions, in whole or in part, for 13 the care and treatment of mental patients; and repealing 14 inconsistent laws." The land was subsequently transferred to the 15 use of the Department of Military Affairs by the act of January 16 26, 1966 (1965 P.L.1610, No.569), entitled "An act authorizing 17 the Department of Property and Supplies, with the approval of 18 the Governor, to transfer and convey to the Department of 19 Military Affairs 17.6885 acres, more or less, of land situate in 20 the fifty-eighth ward of the City of Philadelphia, 21 Pennsylvania," and the act of December 10, 1969 (P.L.360, 22 No.157), entitled "An act authorizing the Department of Property 23 and Supplies to transfer the jurisdiction and control over 7.852 24 acres of land situate in the 58th Ward of the City of 25 Philadelphia, Pennsylvania, to the Department of Military 26 Affairs with the approval of the Secretary of Public Welfare and 27 the Governor." 28 (e) The above transfers shall be made under and subject, 29 nevertheless, to all easements, servitudes and rights of others, 30 including, but not confined to, streets, roadways and rights of 19940H2861B4437 - 13 -
1 any telephone, telegraph, water, electric, gas or pipeline 2 companies, as well as under and subject, nevertheless, to any 3 estate or tenancies vested in third persons, whether or not 4 appearing of record, for any portion of the said land or 5 improvements erected thereon. 6 Section 2. The parcels of land herein described, and the 7 jurisdiction and control over the same herein authorized to be 8 transferred shall be transferred free and clear of any 9 limitations or rights of reversion more particularly set forth 10 in section 1 of the act of September 29, 1938 (Sp.Sess., P.L.53, 11 No.21), entitled, as reenacted and amended, "An act relating to 12 institutions of counties, cities, wards, boroughs, townships, 13 institution districts and other political subdivisions, for the 14 care, maintenance, and treatment of mental patients; providing 15 for the transfer to the Commonwealth for the care, maintenance 16 and treatment of mental patients of such institutions, and all 17 grounds, lands, buildings and personal property of such 18 political subdivisions used for the care and maintenance of 19 indigent persons connected with such mental institutions; 20 providing for the management and operation or closing and 21 abandonment thereof; and the maintenance of mental patients 22 therein; including the collection of maintenance in certain 23 cases; providing for the retransfer of certain property to 24 counties, cities, wards, boroughs, townships, institution 25 districts and other political subdivisions under certain 26 circumstances; conferring and imposing upon the Governor, the 27 Department of Welfare, the courts of common pleas and counties, 28 cities, wards, boroughs, townships, institution districts and 29 other political subdivisions certain powers and duties; 30 prohibiting cities, counties, wards, boroughs, townships, 19940H2861B4437 - 14 -
1 institution districts and other political subdivisions from 2 maintaining and operating institutions, in whole or in part, for 3 the care and treatment of mental patients; and repealing 4 inconsistent laws." 5 Section 3. Upon the appropriation of the necessary funds by 6 the General Assembly, the Department of General Services shall 7 be authorized and directed to construct a veterans home on the 8 land described in section 1(b). Jurisdiction to the land 9 described in section 1(b) shall be transferred to the Department 10 of Military Affairs upon completion of the construction of the 11 veterans home. 12 Section 4.
