                                     AN ACT

     1  Amending the act of May 1, 1933 (P.L.103, No.69), entitled, as
     2     reenacted and amended, "An act concerning townships of the
     3     second class; and amending, revising, consolidating and
     4     changing the law relating thereto," authorizing testing of
     5     sewage sludge.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  The act of May 1, 1933 (P.L.103, No.69), known as
     9  The Second Class Township Code, reenacted and amended November
    10  9, 1995 (P.L.350, No.60), is amended by adding a section to
    11  read:
    12     Section 1522.1.  Sewage Sludge Testing.--The board of
    13  supervisors may by ordinance require unannounced, independent
    14  testing of sewage sludge that is to be land-applied within the
    15  boundaries of the township. The board of supervisors may select
    16  the testing facility of its choice to conduct the testing, and
    17  the testing facility shall use the testing methods approved in
    18  regulations of the Department of Environmental Protection. The

     1  board of supervisors shall have the power to require that the
     2  costs of the testing performed pursuant to the ordinance be
     3  borne entirely by either the entity land-applying the sewage
     4  sludge or the owner of the land where the sewage sludge is being
     5  applied.
     6     Section 2.  This act shall take effect in 60 days.
