A JOINT RESOLUTION 1 Proposing an amendment to the Constitution of the Commonwealth 2 of Pennsylvania, providing for the uses of fees, fines, 3 penalties and other moneys received and collected in 4 connection with any fish law. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby resolves as follows: 7 Section 1. The following amendment to the Constitution of 8 the Commonwealth of Pennsylvania is proposed in accordance with 9 the provisions of Article XI thereof: 10 That Article VIII be amended by adding a section to read: 11 ARTICLE VIII 12 TAXATION AND FINANCE 13 § 18. Fishing license fees, fines, penalties restricted. 14 All fees, fines, penalties and other moneys received and 15 collected in connection with any fish law, shall be placed in a 16 separate fund by the State Treasurer, to be known as The Fish
1 Fund and shall be appropriated by the General Assembly to the 2 Pennsylvania Fish Commission and used solely for: 3 (1) the propagation, protection, management and 4 distribution of fish and the stocking of waters within this 5 Commonwealth; 6 (2) the purchase of lands and waters and the impounding 7 of waters, to make the same available for use by the citizens 8 of this Commonwealth for fishing, hunting and forest 9 purposes; 10 (3) the creation, maintenance and improvement of State 11 fish hatcheries; 12 (4) Field work, gathering spawn and transferring fish; 13 (5) the purchase of lands, buildings, furniture, 14 furnishings, stationery, supplies, materials, equipment, 15 fuel, motor vehicles and boats as may be necessary for the 16 implementation of any fish law; 17 (6) the refund of fees, fines, penalties and other 18 moneys erroneously or unjustly collected; 19 (7) the payment of all costs of fish law administration 20 and collection of funds; and 21 (8) any contingent, incidental or other expenses of any 22 kind or description reasonably necessary in carrying out any 23 fish law. 24 Such proceeds shall not be diverted by transfer or otherwise to 25 any other purpose, except that loans may be made by the State 26 with the approval of the Pennsylvania Fish Commission from the 27 proceeds of such fees, fines and penalties, for a single period 28 not exceeding eight months, but no such loan shall be made 29 within the period of one year from any preceding loan and every 30 loan made in any fiscal year shall be repayable within one month 19780H2793B3798 - 2 -
