AN ACT
1 Amending Title 23 (Domestic Relations) of the Pennsylvania
2 Consolidated Statutes, extending the right of child support
3 to estate of decedent.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 3707 of Title 23 of the Pennsylvania
7 Consolidated Statutes is amended to read:
8 § 3707. Effect of death of either party.
9 (a) Alimony.--Upon the death of the payee party, the right
10 to receive alimony pursuant to this chapter shall cease. Upon
11 the death of the payor party, the obligation to pay alimony
12 shall cease unless otherwise indicated in an agreement between
13 the parties or an order of court.
14 (b) Child support.--Upon the death of a parent of a minor
15 and unemancipated child, the obligation of an estate to pay
16 child support shall continue. The court shall order an amount
17 set aside in reasonable proportion to the extent necessary for
18 support of the minor and unemancipated child in accordance with
1 the amount available from the assets of the estate.
2 Section 2. This act shall take effect in 60 days.
