AN ACT 1 Requiring tree replacement; and imposing fees for tree cutting. 2 The General Assembly of the Commonwealth of Pennsylvania 3 hereby enacts as follows: 4 Section 1. Tree replacement. 5 A tree that is cut for lumber shall be replaced. A tree that 6 is cut for clearing land shall be replaced by planting two trees 7 on noncleared land. 8 Section 2. Cutting permits. 9 (a) Minimum fee.--A minimum fee of $25 is imposed upon a 10 person who cuts a tree which is growing on uninhabited land. 11 (b) Rare trees.--An additional fee of $50 is imposed on the 12 cutting of any tree not native to Pennsylvania. 13 (c) Old trees.--An additional fee of $50 is imposed on the 14 cutting of any tree 100 years of age or older, as long as the 15 tree is healthy. If the tree is diseased or dead, this 16 additional fee is not applicable. 17 (d) Regulations.--The Department of Conservation and Natural
1 Resources shall promulgate regulations to carry out the 2 provisions of this section. 3 Section 3. Establishment of nurseries. 4 Persons who engage in the business of clearing trees from 5 uninhabited land shall establish nurseries of replacement trees. 6 Section 4. Fertilization of nursery. 7 Each area that is set aside for the planting of trees in 8 accordance with section 1 shall be tested for soil nutrients and 9 shall be fertilized as necessary to support new tree growth. 10 Section 5.
