                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, restricting the possession of
     3     firearms.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 18 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 6110.1.  Possession of firearm restricted.
     9     (a)  General rule.--It shall be unlawful for any person 17
    10  years of age or younger to possess a firearm.
    11     (b)  Exceptions.--The provision of subsection (a) shall not
    12  apply to:
    13         (1)  Any person 17 years of age or younger who is:
    14             (i)  in attendance at a hunter's safety course or a
    15         firearms safety course;
    16             (ii)  engaging in practice in the use of a firearm or
    17         target shooting at an established range or any other area
    18         where the discharge of a firearm is not prohibited;

     1             (iii)  engaging in an organized competition involving
     2         the use of a firearm or participating in or practicing
     3         for a performance by an organized group as determined by
     4         the Internal Revenue Service which uses firearms as a
     5         part of such performance;
     6             (iv)  hunting or trapping pursuant to a valid license
     7         issued to such person; or
     8             (v)  traveling with any firearm in that person's
     9         possession being unloaded to or from any activity
    10         described in subparagraph (i), (ii), (iii) or (iv).
    11         (2)  Any person 17 years of age or younger who is on real
    12     property under the control of such person's parent, legal
    13     guardian or grandparent and who has the permission of such
    14     person's parent, legal guardian or grandparent to possess a
    15     handgun.
    16     (c)  Definition.--As used in this section, the term "firearm"
    17  means any pistol or revolver with a barrel less than 15 inches,
    18  any shotgun with a barrel less than 18 inches or any rifle with
    19  a barrel less than 16 inches or any pistol, revolver, rifle or
    20  shotgun with an overall length of less than 26 inches. The
    21  barrel length of a firearm shall be determined by measuring from
    22  the muzzle of the barrel to the face of the closed action, bolt
    23  or cylinder, whichever is applicable.
    24     (d)  Penalty.--
    25         (1)  A person 17 years of age or younger commits a felony
    26     of the second degree if such person possesses a firearm on
    27     school property.
    28         (2)  In all other cases, the person 17 years of age or
    29     younger who possesses a firearm commits a misdemeanor of the
    30     second degree.
