HOUSE BILL

                                     AN ACT

     1  Amending the act of April 22, 1994 (P.L.136, No.20), entitled
     2     "An act mandating health insurance coverage of annual
     3     gynecological examinations and routine pap smears; and making
     4     repeals," further providing for legislative findings and for
     5     mandated coverage.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Sections 2 and 4 of the act of April 22, 1994
     9  (P.L.136, No.20), known as the Women's Preventative Health
    10  Services Act, are amended by adding paragraphs to read:
    11  Section 2.  Declaration of policy.
    12     The General Assembly finds and declares as follows:
    13     * * *
    14     (8)  Technological advances in medical science have led to
    15  the development of newer tests which yield results superior to
    16  those obtained with the conventional cerviocovaginal
    17  papanicolaou test or pap smear.
    18     (9)  In 1996, the United Stated Food and Drug Administration
    19  approved the fluid-based, thin-layer preparation test as a

     1  replacement for the conventional cerviocovaginal papanicolaou
     2  test or pap smear.
     3  Section 4.  Mandated coverage.
     4     A health insurance policy which is delivered, issued for
     5  delivery, renewed, extended or modified in this Commonwealth by
     6  a health care insurer shall provide that the health insurance
     7  benefits applicable under the policy include coverage for
     8  periodic health maintenance to include:

    10         (3)  Other cervical cancer screening methods approved by
    11     the United States Food and Drug Administration. Such
    12     screening shall include fluid-based, thin-layer preparation
    13     tests.
    14     Section 3.  This act shall take effect in 120 days.
