HOUSE BILL

                                     AN ACT

     1  Amending the act of June 3, 1937 (P.L.1333, No.320), entitled
     2     "An act concerning elections, including general, municipal,
     3     special and primary elections, the nomination of candidates,
     4     primary and election expenses and election contests; creating
     5     and defining membership of county boards of elections;
     6     imposing duties upon the Secretary of the Commonwealth,
     7     courts, county boards of elections, county commissioners;
     8     imposing penalties for violation of the act, and codifying,
     9     revising and consolidating the laws relating thereto; and
    10     repealing certain acts and parts of acts relating to
    11     elections," prohibiting certain persons from holding elected
    12     office.

    13     The General Assembly of the Commonwealth of Pennsylvania
    14  hereby enacts as follows:
    15     Section 1.  The act of June 3, 1937 (P.L.1333, No.320), known
    16  as the Pennsylvania Election Code, is amended by adding a
    17  section to read:
    18     Section 1852.1.  Persons Prohibited from Holding Office.--No
    19  person convicted of embezzlement of public moneys, bribery,
    20  perjury, or other infamous crimes shall be eligible to the
    21  General Assembly, or capable of holding any office of trust or
    22  profit in this Commonwealth. As used in this section "infamous


     1  crime" shall mean any violation and conviction for an offense
     2  which would disqualify an individual from holding public office
     3  under:
     4     (1)  Section 7 of Article II of the Constitution of
     5  Pennsylvania.
     6     (2)  18 Pa.C.S. § 4113 (relating to misapplication of
     7  entrusted property and property of government or financial
     8  institutions).
     9     (3)  18 Pa.C.S. Pt. II Art. E (relating to offenses against
    10  public administration).
    11     (4)  Any other felonious violation of the laws of this
    12  Commonwealth for which an individual has been convicted within
    13  the preceding ten years.
    14     (5)  Any violations of similar laws of any other
    15  jurisdiction.
    16     Section 2.  This act shall take effect in 60 days.
