                                     AN ACT

     1  Amending the act of March 3, 1972 (P.L.102, No.37), entitled "An
     2     act regulating the importation and sale of live turtles and
     3     providing for permits to be issued by the Department of
     4     Health," by repealing certain provisions related to permits
     5     and certification.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 1 of the act of March 3, 1972 (P.L.102,
     9  No.37), entitled "An act regulating the importation and sale of
    10  live turtles and providing for permits to be issued by the
    11  Department of Health," is amended to read:
    12     Section 1.  [(a)]  No person shall [bring, cause to be
    13  brought, or transport any live turtle into the Commonwealth of
    14  Pennsylvania, unless] sell, hold for sale or offer for any type
    15  of commercial or public distribution any live turtle or lot of
    16  turtles in this Commonwealth, if the sale, holding for sale or
    17  offering for any type of commercial or public distribution of
    18  such turtle or lot of turtles is [accompanied with a permit
    19  issued by the Department of Health or other agency authorized by

     1  the Department of Health to issue a permit] prohibited by 21 CFR
     2  § 1240.62 (relating to turtles intrastate and interstate
     3  requirements).
     4     [(b)  A permit shall be issued upon request if there is
     5  adequate bacteriological proof that the turtles are free of
     6  salmonellae.
     7     (c)  Adequate bacteriological proof as used in this act shall
     8  consist of a statement issued by the chief public health
     9  official or his designated representative of the state from
    10  which the lot of turtles is shipped, certifying that the turtles
    11  have been found free of salmonellae based upon laboratory
    12  examination of six consecutive specimens taken at intervals of
    13  not less than three days found to be negative for salmonellae in
    14  a laboratory approved for this purpose by the health authorities
    15  of the jurisdiction from which the turtles originate.]
    16     Section 2.  Sections 2, 3, 4, 5 and 6 of the act are
    17  repealed.
    18     Section 3.  Section 7 of the act is amended to read:
    19     Section 7.  Instructions designating the proper care and
    20  treatment of live turtles and information from the Centers for
    21  Disease Control and Prevention on human salmonellosis infection
    22  associated with reptiles shall accompany each retail sale of any
    23  turtle and shall be distributed to the purchaser by the seller
    24  thereof at the time of the sale.
    25     Section 4.  This act shall take effect immediately.
