        SENATOR GREENLEAF, JUDICIARY, IN SENATE, AS AMENDED,
           NOVEMBER 9, 2004

                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, further providing for
     3     exemptions from jury duty and for summary offenses involving   <--
     4     vehicles.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 4503(a) of Title 42 of the Pennsylvania    <--
     8  Consolidated Statutes is amended by adding a paragraph to read:
     9  § 4503.  Exemptions from jury duty.
    10     (a)  General rule.--No person shall be exempt or excused from
    11  jury duty except the following:
    12         * * *
    13         (5)  Persons 75 years of age or older who opt not to
    14     serve.

    16     Section 2.  Section 5553(c) and (e) of Title 42 are amended

     1  to read:
     2     SECTION 1.  SECTION 5553(C) AND (E) OF TITLE 42 OF THE         <--
     3  PENNSYLVANIA CONSOLIDATED STATUTES ARE AMENDED TO READ:
     4  § 5553.  Summary offenses involving vehicles.
     5     * * *
     6     (c)  Exception.--
     7         (1)  Where proceedings are timely commenced against a
     8     person reasonably believed to have committed the offense
     9     charged and it subsequently appears that a person other than
    10     the person charged is the offender, proceedings may be
    11     commenced against the other person within 30 days after the
    12     identity of the person is discovered and not thereafter.
    13         (2)  Proceedings for summary offenses under Title 75 may
    14     be commenced within 365 days after the commission of the
    15     offense, the discovery of the commission of the offense or
    16     the discovery of the identity of the offender, whichever is
    17     later, and not thereafter if the offense involved an accident
    18     resulting in the bodily injury or death of any person.

    20     (e)  Disposition of proceedings within [two] three years.--No
    21  proceedings shall be held or action taken pursuant to a summary
    22  offense under Title 75 subsequent to [two] three years after the
    23  commission of the offense.
    24     Section 3 2.  This act shall take effect in 60 days.           <--
