                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, adding a definition of "sexual
     3     penetration"; and further providing for child molestation.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 3101 of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 3101.  Definitions.
     9     Subject to additional definitions contained in subsequent
    10  provisions of this chapter which are applicable to specific
    11  provisions of this chapter, the following words and phrases when
    12  used in this chapter shall have, unless the context clearly
    13  indicates otherwise, the meanings given to them in this section:
    14     "Deviate sexual intercourse."  Sexual intercourse per os or
    15  per anus between human beings who are not husband and wife, and
    16  any form of sexual intercourse with an animal.
    17     "Indecent contact."  Any touching of the sexual or other
    18  intimate parts of the person for the purpose of arousing or

     1  gratifying sexual desire, in either person.
     2     "Sexual intercourse."  In addition to its ordinary meaning,
     3  includes intercourse per os or per anus, with some penetration
     4  however slight; emission is not required.
     5     "Sexual penetration."  Sexual intercourse, cunnilingus,
     6  fellatio or anal intercourse between persons or insertion of the
     7  hand, finger or object into the genital or anal openings, either
     8  by a person or upon his instruction, with some insertion,
     9  however slight; emission is not required.
    10     Section 2.  Title 18 is amended by adding a section to read:
    11  § 3128.  Child molestation.
    12     A person 18 years of age or older who has indecent contact
    13  with another person under 14 years of age who is not his spouse,
    14  or causes the other person to have indecent contact with him, is
    15  guilty of child molestation, a felony of the third degree.
    16     Section 3.  This act shall take effect immediately.
