           DENLINGER, GEORGE, GINGRICH, GOOD, HARPER, HORSEY, KILLION,
           MUSTIO, REICHLEY, SOLOBAY, STEIL, THOMAS, TIGUE, WEBER AND
           YOUNGBLOOD, MARCH 23, 2004

                                     AN ACT

     1  Amending the act of May 1, 1933 (P.L.103, No.69), entitled, as
     2     reenacted and amended, "An act concerning townships of the
     3     second class; and amending, revising, consolidating and
     4     changing the law relating thereto," further providing for
     5     township and special tax levies.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 3205(a)(7) of the act of May 1, 1933
     9  (P.L.103, No.69), known as The Second Class Township Code,
    10  reenacted and amended November 9, 1995 (P.L.350, No.60), is
    11  amended and the subsection is amended by adding a paragraph to
    12  read:
    13     Section 3205.  Township and Special Tax Levies.--(a)  The
    14  board of supervisors may by resolution levy taxes upon all real
    15  property within the township made taxable for township purposes,
    16  as ascertained by the last adjusted valuation for county
    17  purposes, for the purposes and at the rates specified in this
    18  section. All taxes shall be collected in cash.

     2     (7)  An annual tax sufficient to pay interest and principal
     3  on any indebtedness incurred under the former act of July 12,
     4  1972 (P.L.781, No.185), known as the "Local Government Unit Debt
     5  Act[.]" or 53 Pa.C.S. Pt. VII Subpt. B (relating to indebtedness
     6  and borrowing).

     8     (11)  An annual tax not exceeding three mills to construct
     9  and maintain storm water management facilities within the
    10  township. If an annual tax is proposed to be set at a level
    11  higher than three mills, the question shall be submitted to the
    12  voters of the township.

    14     Section 2.  This act shall take effect in 60 days.
