           GILLESPIE, GINGRICH, GODSHALL, HENNESSEY, HERSHEY, HORNAMAN,
           HUTCHINSON, MAHONEY, PHILLIPS, PYLE, RAPP, ROHRER, SONNEY,
           SURRA AND WOJNAROSKI, APRIL 1, 2008

        AS REPORTED FROM COMMITTEE ON GAME AND FISHERIES, HOUSE OF
           REPRESENTATIVES, AS AMENDED, JUNE 26, 2008

                                     AN ACT

     1  Amending Title 34 (Game) of the Pennsylvania Consolidated
     2     Statutes, further providing for the definition of "safety
     3     zone."

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 2505(c) of Title 34 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 2505.  Safety zones.
     9     * * *
    10     (c)  Definition.--As used in this section, the term "safety
    11  zone" means:
    12         (1)  Except as otherwise provided in [paragraph (2)]
    13     paragraphs (2) and (3), the area within 150 yards around and
    14     that area which is below the highest point of any occupied
    15     dwelling house, residence, or other building or camp occupied
    16     by human beings, or any barn, stable, or other building used
    17     in connection therewith or any attached or detached

     1     playground of any school, nursery school or day-care center.
     2         (2)  When applied to properly licensed persons hunting
     3     with bow and arrow or crossbow, the area within 50 yards
     4     around and that area which is below the highest point of any
     5     occupied dwelling house, residence or other building or camp
     6     occupied by human beings or any barn, stable or other
     7     building used in connection therewith and the area within 150
     8     yards around and that area which is below the highest point
     9     of any attached or detached playground of any school, nursery
    10     school or day-care center.
    11         (3)  When applied to properly licensed furtakers when      <--
    12     trapping within any waterway, watercourse, marsh, pond or
    13     dam, or any area TRAPPING WITHIN A PERMANENT WATERCOURSE AND   <--
    14     USING TRAPS SUBMERGED IN WATER, OR making use of any special
    15     permit issued in accordance with this title or commission
    16     regulations, the area within 50 yards around any occupied
    17     dwelling house, residence or other building or camp occupied
    18     by human beings, or any barn, stable or other building used
    19     in connection therewith and the area within 150 yards around
    20     any attached or detached playground of any school, nursery
    21     school or day-care center.
    22     Section 2.  This act shall take effect in 60 days.
