AN ACT 1 Amending Title 30 (Fish) of the Pennsylvania Consolidated 2 Statutes, further providing for refund of moneys paid 3 erroneously or unjustly. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 501 of Title 30 of the Pennsylvania 7 Consolidated Statutes is amended to read: 8 § 501. Refund of moneys paid erroneously or unjustly. 9 Whenever the commission is satisfied that any fee, fine or 10 any other money was erroneously or unjustly paid into the State 11 Treasury under any of the provisions of this title, [the 12 commission may by resolution, within two years after the 13 payment, direct the executive director to draw a requisition 14 upon the Fish Fund or Boat Fund, as appropriate, for the amount 15 involved. Upon receipt of the requisition and an extract of the 16 minutes of the commission,] a refund shall be paid in favor of
1 the person from whom the fee, fine or other money was 2 erroneously or unjustly collected. When an unused license or 3 boat registration is returned to the commission in the unopened 4 envelope in which it was delivered, the applicable fee therefor 5 shall be deemed to have been erroneously collected. 6 Section 2.
