                                     AN ACT

     1  Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
     2     act to consolidate, editorially revise, and codify the public
     3     welfare laws of the Commonwealth," providing for payments for
     4     burial expenses; and making a repeal.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Article IV of the act of June 13, 1967 (P.L.31,
     8  No.21), known as the Public Welfare Code, is amended by adding a
     9  subarticle to read:
    10                   (n)  Burial Services Allowance
    11     Section 494.  Payments for Burial Services.--(a)  The
    12  department shall pay a burial or cremation allowance in the
    13  amount of one thousand dollars ($1,000) which may be
    14  supplemented by the decedent's estate or another party in an
    15  amount not to exceed one thousand dollars ($1,000), in
    16  accordance with the eligibility requirements of 55 Pa. Code §
    17  285.3(a)(3) (relating to requirements). Individuals who die but


     1  have never sought assistance shall be reviewed for eligibility
     2  to qualify for a grant allowance. If eligible, an allowance
     3  shall be paid by the department.
     4     (b)  Separate payments totaling an amount not to exceed the
     5  amount authorized in subsection (a) may be made for funeral,
     6  cemetery and crematorium expenses.
     7     Section 2.  (a)  55 Pa. Code § 285.3(d) is repealed.
     8     (b)  All other provisions of 55 Pa. Code are repealed insofar
     9  as they are inconsistent with this act.
    10     Section 3.  This act shall take effect in 60 days.
