                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for the operation of emergency
     3     vehicles.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Sections 3742(a), 3743(a), 3744(a) and 3745 of
     7  Title 75, act of November 25, 1970 (P.L.707, No.230), known as
     8  the Pennsylvania Consolidated Statutes are amended to read:
     9  § 3742.  Accidents involving death or personal injury.
    10     (a)  General rule.--[The] Except as provided in section 3755
    11  (relating to accidents involving emergency vehicles), the driver
    12  of any vehicle involved in an accident resulting in injury or
    13  death of any person shall immediately stop the vehicle at the
    14  scene of the accident or as close thereto as possible but shall
    15  then forthwith return to and in every event shall remain at the
    16  scene of the accident until he has fulfilled the requirements of
    17  section 3744 (relating to duty to give information and render
    18  aid). Every stop shall be made without obstructing traffic more

     1  than is necessary.

     3  § 3743.  Accidents involving damage to attended vehicle
     4           or property.
     5     (a)  General rule.--[The] Except as provided in section 3755
     6  (relating to accidents involving emergency vehicles), the driver
     7  of any vehicle involved in an accident resulting only in damage
     8  to a vehicle or other property which is driven or attended by
     9  any person shall immediately stop the vehicle at the scene of
    10  the accident or as close thereto as possible but shall forthwith
    11  return to and in every event shall remain at the scene of the
    12  accident until he has fulfilled the requirements of section 3744
    13  (relating to duty to give information and render aid). Every
    14  stop shall be made without obstructing traffic more than is
    15  necessary.

    17  § 3744.  Duty to give information and render aid.
    18     (a)  General rule.--[The] Except as provided in section 3755
    19  (relating to accidents involving emergency vehicles), the driver
    20  of any vehicle involved in an accident resulting in injury to or
    21  death of any person or damage to any vehicle or other property
    22  which is driven or attended by any person shall give his name,
    23  address and the registration number of the vehicle he is
    24  driving, and shall upon request exhibit his driver's license and
    25  proof of insurance to any person injured in the accident or to
    26  the driver or occupant of or person attending any vehicle or
    27  other property damaged in the accident and shall give the
    28  information and upon request exhibit the license and proof of
    29  insurance to any police officer at the scene of the accident or
    30  who is investigating the accident and shall render to any person

     1  injured in the accident reasonable assistance, including the
     2  making of arrangements for the carrying of the injured person to
     3  a physician, surgeon or hospital for medical or surgical
     4  treatment if it is apparent that treatment is necessary or if
     5  requested by the injured person.

     7  § 3745.  Accidents involving damage to unattended vehicle or
     8           property.
     9     [The] Except as provided in section 3755 (relating to
    10  accidents involving emergency vehicles), the driver of any
    11  vehicle which collides with or is involved in an accident with
    12  any vehicle or other property which is unattended resulting in
    13  any damage to the other vehicle or property shall immediately
    14  stop the vehicle at the scene of the accident or as close
    15  thereto as possible and shall then and there either locate and
    16  notify the operator or owner of the damaged vehicle or other
    17  property of his name, address, information relating to the
    18  certificate of insurance and the registration number of the
    19  vehicle being driven or shall attach securely in a conspicuous
    20  place in or on the damaged vehicle or other property a written
    21  notice giving his name, address, information relating to the
    22  certificate of insurance and the registration number of the
    23  vehicle being driven and shall without unnecessary delay notify
    24  the nearest office of a duly authorized police department. Every
    25  stop shall be made without obstructing traffic more than is
    26  necessary.
    27     Section 2.  Title 75 is amended by adding a section to read:
    28  § 3755.  Accidents involving emergency vehicles.
    29     (a)  General rule.--The driver of an emergency vehicle,
    30  involved in an accident when responding to an emergency call or

     1  when in the pursuit of an actual or suspected violator of the
     2  law or when responding to but not upon returning from a fire
     3  alarm, shall comply with the provisions of sections 3742
     4  (relating to accidents involving death or personal injury)
     5  through 3745 (relating to accidents involving damage to
     6  unattended vehicle or property) inclusive, as appropriate,
     7  except that the driver shall not be required to remain at the
     8  scene of the accident until the requirements of any of these
     9  sections have been fulfilled if the requirements are fulfilled
    10  by another person acting in behalf of the driver or by radio
    11  communication with police, fire, rescue or a similar agency
    12  established to deal with emergencies.
    13     (b)  Penalty.--Any person violating this section is guilty of
    14  a summary offense, punishable by a fine of $300 or imprisonment
    15  for not more than 90 days, or both.
    16     Section 3.  This act shall take effect in 60 days.
