           PETRARCA AND BARBER, FEBRUARY 25, 1980

        AS REPORTED FROM COMMITTEE ON PROFESSIONAL LICENSURE, HOUSE OF
           REPRESENTATIVES, AS AMENDED, MARCH 26, 1980

                                     AN ACT

     1  Amending the act of June 19, 1931 (P.L.589, No.202), entitled,
     2     as amended, "An act to promote the public health and safety,
     3     by providing for the examination and licensure of those who
     4     desire to engage in the occupation of barbering; regulating
     5     barber shops and barber schools, and students therein;
     6     regulating compensation for service rendered; conferring
     7     certain powers and duties on the Department of State; and
     8     providing penalties," further providing for one barber barber
     9     shops AND MANAGER-BARBER LICENSES.                             <--

    10     The General Assembly of the Commonwealth of Pennsylvania
    11  hereby enacts as follows:
    12     SECTION 1.  SECTION 3.1, ACT OF JUNE 19, 1931 (P.L.589,        <--
    13  NO.202), REFERRED TO AS THE BARBERS' LICENSE LAW, AMENDED
    14  NOVEMBER 26, 1978 (P.L.1299, NO.313), IS AMENDED TO READ:
    15     SECTION 3.1.  ANY REGISTERED BARBER, WITH NOT LESS THAN AN
    16  EIGHTH GRADE EDUCATION, ACTIVELY ENGAGED IN THE PRACTICE OF
    17  BARBERING, AS A LICENSED BARBER, FOR ONE OR MORE YEARS MAY APPLY
    18  TO THE BOARD FOR A MANAGER-BARBER CERTIFICATE TO MANAGE OR
    19  OPERATE A BARBER SHOP BY FILING AN APPLICATION ACCOMPANIED BY A
    20  FEE SO PRESCRIBED UNDER THIS ACT OR BY THE BOARD, AND PRESENTING

     1  HIMSELF OR HERSELF FOR AN EXAMINATION. ANY PERSON WHO FAILS TO
     2  APPEAR FOR EXAMINATION AT TWO SUCCESSIVE MEETINGS OF THE BOARD
     3  WHEN EXAMINATIONS ARE SCHEDULED SHALL FORFEIT THE FEE. THE
     4  EXAMINATION SHALL BE SCHEDULED AS PROVIDED IN SECTION 6 OF THIS
     5  ACT. THE APPLICANT SHALL BE EXAMINED AND IF THE BOARD IS
     6  SATISFIED AS A RESULT OF THE EXAMINATION THAT HE OR SHE HAS
     7  SUFFICIENT EDUCATION AND KNOWLEDGE CONCERNING BARBER SHOP
     8  MANAGEMENT HE OR SHE SHALL BE ISSUED A MANAGER-BARBER
     9  CERTIFICATE. THE BOARD SHALL PROPERLY NOTIFY EVERY REGISTERED
    10  BARBER THAT IF HE OR SHE HAS BEEN ACTIVELY ENGAGED IN THE
    11  PRACTICE OF BARBERING HE OR SHE SHALL, UPON FILING AN
    12  APPLICATION THEREFOR PRIOR TO JANUARY 1, [1980] 1981, BE
    13  CERTIFIED AS A MANAGER-BARBER WITHOUT EXAMINATION.
    14     Section 1. 2.  Subsection (a) of section 12, act of June 19,   <--
    15  1931 (P.L.589, No.202), referred to as the Barbers' License Law,
    16  OF THE ACT, amended December 2, 1976 (P.L.1267, No.282), is       <--
    17  amended to read:
    18     Section 12.  (a)  [All]  Except for one barber barber shops
    19  which shall be under the immediate supervision of a registered
    20  barber, all other barber shops shall at all times be under the
    21  immediate supervision of a manager-barber. In no barber shop
    22  shall there be more than one student. All barber schools shall
    23  keep prominently displayed at every entrance to said school a
    24  sign reading "Barber School." Any copartnership, corporation, or
    25  person desiring to operate or conduct a barber shop or barber
    26  school, shall first secure from the board a permit or
    27  registration certificate to do so, and shall keep the same
    28  prominently displayed. The fee for registration of each barber
    29  shop shall be five dollars for each permit, and the biennial
    30  renewal fee shall be five dollars. The fee for registration of

     1  each barber school shall be one hundred dollars, and the annual
     2  renewal fee therefor shall be fifty dollars. The board may pass
     3  upon the qualifications, appointments, and course of study in
     4  said school, which shall be not less than one thousand two
     5  hundred fifty (1250) hours and not less than twelve months. All
     6  barber schools shall have not less than one registered teacher
     7  for every twenty students, and in no case less than one full-
     8  time teacher, who shall be in attendance at all times during the
     9  hours the school is open for instruction.
    10     Any person who holds a permit or registration certificate to
    11  operate or conduct a barber shop or barber school, who shall
    12  fail to apply for a renewal of his or her permit or registration
    13  certificate and who continues to operate or conduct a barber
    14  shop or barber school, shall, on summary conviction thereof, be
    15  sentenced to pay a fine of not less than ten dollars nor more
    16  than ninety dollars, and in case of non-payment of the fine and
    17  costs of prosecution to undergo an imprisonment for a period not
    18  exceeding ten days.
    19     Any licensed manager-barber may become a teacher-trainee in a
    20  licensed barber school provided that he or she has all the
    21  qualifications to become a barber-teacher. After he has trained
    22  for one thousand two hundred fifty (1,250) hours under a
    23  licensed teacher in a licensed barber school, the trainee may
    24  make application to the board for a teacher's certificate.
