                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for surrendering registration
     3     plates, cards and drivers' licenses.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 1376 of Title 75 of the Pennsylvania
     7  Consolidated Statutes is amended by adding a subsection to read:
     8  § 1376.  Surrender of registration plates and cards upon
     9             suspension or revocation.

    11     (c.1)  Receipt upon seizure.--Any person who seizes a
    12  registration plate or registration card under subsection (b)
    13  shall provide a departmental receipt for the plate or card to
    14  the person from whom the registration plate or registration card
    15  was seized.

     1     Section 2.  Section 1540(c) of Title 75 is amended to read:
     2  § 1540.  Surrender of license.
     3     * * *
     4     (c)  Seizure of revoked, suspended, canceled or disqualified
     5  licenses.--
     6         (1)  The department may delegate authority to the
     7     following persons to seize the driver's license of any person
     8     whose driver's license has been ordered to be surrendered by
     9     a court or district attorney or by the department:
    10             (i)  A designated Commonwealth employee.
    11             (ii)  Members of the Pennsylvania State Police.
    12             (iii)  Local police officers.
    13             (iv)  Sheriffs or deputy sheriffs.
    14             (v)  Constables or deputy constables. If constables
    15         and deputy constables are delegated authority to seize
    16         drivers' licenses under this subsection, they shall be
    17         compensated by the department at the rate of $15 for each
    18         driver's license seized, plus mileage. The department
    19         shall pay a constable or deputy constable within 30 days
    20         after a documented request is submitted to it.
    21         (2)  The department shall, by regulation, prescribe the
    22     manner of selecting those persons who are delegated authority
    23     under this subsection to seize the drivers' licenses.
    24         (3)  Any person who seizes a driver's license under
    25     paragraph (1) shall provide a departmental receipt for the
    26     license to the person from whom the driver's license was
    27     seized.
    28     Section 3.  This act shall take effect in 60 days.
