AN ACT 1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An 2 act relating to the public school system, including certain 3 provisions applicable as well to private and parochial 4 schools; amending, revising, consolidating and changing the 5 laws relating thereto," removing restrictions on retirement 6 credits for leaves of absence for elective public offices. 7 The General Assembly of the Commonwealth of Pennsylvania 8 hereby enacts as follows: 9 Section 1. Section 1182, act of March 10, 1949 (P.L.30, 10 No.14), known as the "Public School Code of 1949," added 11 February 8, 1980 (P.L.3, No.2), is amended to read: 12 Section 1182. Leave for Elective Public Office.--Any full- 13 time employe of a school entity who has been an employe for at 14 least five (5) years and who has been elected to public office 15 as a county official in any county of this Commonwealth, shall 16 be entitled to a leave of absence for the first four (4) years 17 of the elected period of service: Provided, however, That such 18 leave of absence shall be without pay. Any employe qualifying 19 for and desiring leave for elective public office shall file a
1 written statement declaring the employe's intent to take a leave 2 of absence together with a copy of the employe's official 3 certification of election with the secretary of the school 4 entity. Certification of election shall be recorded in the 5 school board minutes at the next regular meeting of the board of 6 directors. [No] Any employe on such leave of absence shall be 7 eligible for retirement credit or for the purchase of retirement 8 credit [at any future date for time spent on leave of absence] 9 pursuant to 24 Pa.C.S. § 8302(b) (relating to credited school 10 service). Should the employe decide to return to full-time 11 employment with the school entity at the conclusion of the leave 12 of absence, the employe shall be entitled to a position similar 13 to that which the employe held prior to the leave of absence. 14 Nothing in this section shall prohibit a board of school 15 directors from granting a leave of absence, at its discretion, 16 to any employe who has been elected to any public office other 17 than as a county official. 18 Section 2.
