AN ACT

1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, further providing for securing loads in vehicles.

3The General Assembly of the Commonwealth of Pennsylvania
4hereby enacts as follows:

5Section 1. Section 4903 of Title 75 of the Pennsylvania
6Consolidated Statutes is amended by adding a subsection to read:

7§ 4903. Securing loads in vehicles.

9(d.1) Transportation of an agricultural product.--

10(1) Subsection (a) shall not apply to the transportation
11of an agricultural product in bulk produced by a farmer in
12the course of harvesting or on-farm storage of the
13agricultural product, if all of the following apply:

14(i) The transportation is performed in a vehicle
15with four sides of the type and strength reasonably
16expected to essentially contain the agricultural product
17being transported.

1(ii) The height of the load of agricultural product
2being transported does not exceed the height of the sides
3of the transporting vehicle.

4(iii) The transporting vehicle is operated or moved
5on a highway other than a freeway between farms that the
6farmer owns or operates.

7(iv) The transporting vehicle is operated or moved
8at a speed not greater than 45 miles per hour.

9(2) Notwithstanding paragraph (1), a vehicle subject to
1067 Pa. Code Ch. 229 (relating to interstate motor carrier 
11safety requirements) or 231 (relating to intrastate motor 
12carrier safety requirements) transporting an agricultural
13product that has been unitized by wrapping, strapping,
14banding or edge protection devices so as to constitute cargo
15must comply with the applicable requirements prescribed in
16regulations for fastening or containment of cargo.

17(3) For purposes of this subsection, the transportation
18of an agricultural product shall include a transportation
19activity performed by a farmer or performed under employment
20or contract with the farmer.
