AN ACT 1 Authorizing the Department of General Services, with the 2 approval of the Governor and the Department of Environmental 3 Resources, to convey a certain parcel of property in Manheim 4 Township, York County acquired pursuant to the "Project 70 5 Land Acquisition and Borrowing Act," in exchange for two 6 parcels of land located in Manheim Township, York County, 7 Pennsylvania. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. (a) Pursuant to the requirements of subsection 11 (b) of section 20, act of June 22, 1964 (Sp.Sess., P.L.131, 12 No.8), known as the "Project 70 Land Acquisition and Borrowing 13 Act," the General Assembly hereby authorizes the Department of 14 General Services, with the approval of the Department of 15 Environmental Resources and the Governor to convey to Charles W. 16 Grubb and Evelyn M. Grubb, husband and wife, Parcel No. 1 17 described in section 2, located in Manheim Township, York 18 County, Pennsylvania, in exchange for Parcels No. 2 and 3, 19 described in section 2 and located in Manheim Township, York 20 County, Pennsylvania.
1 (b) Said land conveyed to Charles W. Grubb and Evelyn M. 2 Grubb shall be free of restrictions on use and alienation 3 prescribed by section 20 of the "Project 70 Land Acquisition and 4 Borrowing Act," upon substitution of the Project 70 land for 5 land at least equal in value, subject, however, to all existing 6 easement of record. 7 Section 2. The parcel of land authorized to be transferred 8 pursuant to this act to Charles W. Grubb and Evelyn M. Grubb is 9 more particularly described as follows: 10 Parcel No. 1 11 All that certain parcel of land situate in the Township of 12 Manheim, County of York, Commonwealth of Pennsylvania, more 13 particularly bounded and described as follows: 14 Beginning at a copperweld pin being a common corner of lands 15 of Sandruck, lands of Charles Grubb and lands of Codorus State 16 Park; thence by lands of Codorus State Park north 54 degrees 54 17 minutes 20 seconds west 347.78 feet to an iron pin; thence 18 continuing by lands last mentioned north 36 degrees 09 minutes 19 06 seconds east 101.64 feet to a corner common to lands last 20 mentioned, lands being conveyed from Grubb to the Commonwealth 21 and other lands of Charles Grubb; thence along other lands of 22 Charles Grubb south 67 degrees 57 minutes 14 seconds east 314.03 23 feet to a corner; thence continuing by lands last mentioned 24 south 22 degrees 02 minutes 46 seconds west 177.10 feet to a 25 copperweld pin place of beginning. 26 Reserving to the Commonwealth of Pennsylvania such easements 27 in the aforesaid Parcel No. 1 as it determines to be necessary 28 for planting and maintaining trees and other growth for 29 screening purposes and for ingress, egress and regress for the 30 purpose of planting and maintaining the screening areas and the 19810H2011B2458 - 2 -
1 State Park boundary lines. In addition to the reservation of 2 easements, Commonwealth may impose such restrictions on the use 3 of said Parcel No. 1 as it determines are reasonably necessary 4 to preserve the aesthetic quality of the area in the vicinity of 5 said Parcel No. 1. Containing 1.044 acres of land. 6 Being part of those same two tracts of land designated as 7 acquisition numbers 7 and 13 of a Declaration of Taking from P. 8 H. Glatfelter Company by the Commonwealth of Pennsylvania dated 9 February 14, 1966 and filed to No. 179 May Term 1966 in the 10 Court of Common Pleas of York County, Pennsylvania. 11 In exchange for: 12 Lands to the Commonwealth of Pennsylvania 13 All those two certain parcels of land situate in the Township 14 of Manheim, County of York, Commonwealth of Pennsylvania, more 15 particularly bounded and described as follows: 16 Parcel No. 2 17 Beginning at a nail on the center of Legislative Route 66120 18 and being a common corner of lands of Saint Paul's DUBs Union 19 Church and lands herein described; thence leaving said 20 Legislative Route 66120 and along lands of Saint Paul's Church 21 south 44 degrees 40 minutes 29 seconds west 256.64 feet to a 22 copperweld pin common to lands last mentioned and other lands of 23 Charles Grubb; thence by other lands of Charles Grubb north 68 24 degrees 16 minutes 28 seconds west 102.15 feet to a corner of 25 lands last mentioned and Codorus State Park and being a common 26 corner of lands to be conveyed by grantor to grantee 27 hereinafter; thence by line common to lands of Codorus State 28 Park north 43 degrees 31 minutes 38 seconds east 295.68 feet to 29 a nail in the center of Legislative Route 66120; thence by lands 30 of Saint Paul's Church along the center of Legislative Route 19810H2011B2458 - 3 -
1 66120 south 45 degrees 45 minutes 40 seconds east 100.00 feet to 2 a nail in center of said Legislative Route 66120, place of 3 beginning. Containing 0.616 acre. 4 Parcel No. 3 5 Beginning at a corner common to lands first herein described 6 said corner lying south 43 degrees 31 minutes 38 seconds west 7 295.68 feet from the center of Legislative Route 66120, and said 8 point of beginning, also being common to lands of Codorus State 9 Park and other lands of Charles Grubb; thence by lands of 10 Charles Grubb south 36 degrees 09 minutes 06 seconds west 582.85 11 feet to a corner common to lands of Charles Grubb, lands of 12 Codorus State Park to be conveyed to Charles Grubb and other 13 lands of Codorus State Park; thence by other lands of Codorus 14 State Park north 67 degrees 57 minutes 14 seconds west 80.41 15 feet to a corner; thence continuing by lands last mentioned 16 north 43 degrees 31 minutes 38 seconds east 607.46 feet to the 17 place of beginning. Containing 0.429 acre of land. 18 The two above tracts of land being a portion of that same 19 tract of land that the Commonwealth of Pennsylvania, by a deed 20 dated August 18, 1980 and recorded on August 18, 1980 in the 21 Recorder of Deeds Office in and for the County of York in Deed 22 Book Volume 81Q Page 548, granted and conveyed to the said 23 Charles Grubb. 24 Section 3. Costs and fees related to the preparation and 25 recordation of documents relating to the exchange shall be borne 26 by the grantee. 27 Section 4.
