AN ACT 1 Amending the act of March 1, 1988 (P.L.82, No.16), entitled "An 2 act providing for the establishment, implementation and 3 administration of the Pennsylvania Infrastructure Investment 4 Authority; imposing powers and duties on a board of trustees; 5 transferring the rights, powers, duties and obligations of 6 the Water Facilities Loan Board to the Pennsylvania 7 Infrastructure Investment Authority; providing for the 8 issuance of notes and bonds; providing for financial 9 assistance and for a comprehensive water facilities plan; 10 authorizing a referendum to incur indebtedness; making an 11 appropriation; and making repeals," further changing the 12 definition of "project"; including a definition of "septage"; 13 and changing the financial assistance priorities to include 14 septage treatment and disposal. 15 The General Assembly of the Commonwealth of Pennsylvania 16 hereby enacts as follows: 17 Section 1. The definition of "project" in section 3 of the 18 act of March 1, 1988 (P.L.82, No.16), known as the Pennsylvania 19 Infrastructure Investment Authority Act, is amended and the 20 section is amended by adding a definition to read: 21 Section 3. Definitions. 22 The following words and phrases when used in this act shall
1 have the meanings given to them in this section unless the 2 context clearly indicates otherwise: 3 * * * 4 "Project." The eligible costs associated with the 5 acquisition, construction, improvement, expansion, extension, 6 repair or rehabilitation of all or part of any facility or 7 system, whether publicly or privately owned, for the collection, 8 treatment or disposal of wastewater, including industrial waste, 9 and septage or for the supply, treatment, storage or 10 distribution of drinking water. 11 * * * 12 "Septage." The liquid and solid material pumped from a 13 septic tank or similar domestic sewage treatment system, or a 14 holding tank, when the system is cleaned or maintained. 15 * * * 16 Section 2. Section 10(b) of the act is amended to read: 17 Section 10. Financial assistance. 18 * * * 19 (b) Financing priorities.--In assigning priorities for 20 projects, the board shall consult with the Department of 21 Commerce and the department. In addition to any requirements of 22 Federal law imposed on the use of Federal funds, the board shall 23 determine priorities based on factors which include, but are not 24 limited to: 25 (1) Benefits to public health. 26 (2) The contribution to and impact of the project on 27 economic development as well as social and environmental 28 values. 29 (3) Benefits to public safety or welfare. 30 (4) Improvement in the ability of an applicant to come 19910H2005B2496 - 2 -
1 into compliance with State and Federal statutes, regulations 2 and standards. 3 (5) Improvement in the adequacy or efficiency of the 4 water supply or sewage treatment system. 5 (6) The cost-effectiveness of the project. 6 (7) Whether the governmental unit to be served by a 7 sewage treatment system is subject to construction or 8 connection limitations issued by the department and the date 9 that any such limitation was issued. 10 (8) Whether the project encourages consolidation of 11 water or sewer systems, where such consolidation would enable 12 the customers of the systems to be more effectively and 13 efficiently served. 14 (9) Whether the sewage treatment system includes 15 facilities for the treatment of septage. 16 * * * 17 Section 3. This act shall apply to all applications which 18 are filed on or after the effective date of this act. 19 Section 4. This act shall take effect in 60 days. G12L64RZ/19910H2005B2496 - 3 -
