AN ACT

 

1Establishing the Citizens Compensation Commission and providing
2for its powers and duties; and repealing provisions of the
3Public Official Compensation Law.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Short title.

7This act shall be known and may be cited as the Citizens
8Compensation Commission Act.

9Section 2. Definitions.

10The following words and phrases when used in this act shall
11have the meanings given to them in this section unless the
12context clearly indicates otherwise:

13"Commission." The Citizens Compensation Commission
14established by this act.

15Section 3. Commission established.

16The Citizens Compensation Commission is established. The
17commission shall annually determine the salary paid to members
18of the General Assembly and the amount of additional

1compensation to be paid to officers and leaders of the Senate
2and House of Representatives.

3Section 4. Membership.

4(a) Appointment.--The commission shall consist of members
5who must be residents of this Commonwealth and who shall be
6appointed by the Governor. The Governor shall appoint:

7(1) Two members who are representatives of labor
8organizations.

9(2) Two members who own or operate a small business.

10(3) Two members who are taxpayers of this Commonwealth.

11(4) One member who is an executive level employee of a
12large for-profit business entity.

13(5) One member who is the director or an officer of a
14nonprofit organization.

15(6) One member who is a professional in the field of
16employee compensation.

17(b) Ineligibility.--The appointees shall be persons not
18holding any public office nor employed full time with
19compensation by the Commonwealth while serving on the
20commission.

21(c) Term.--The term of a member is three years, commencing
22July 1, 2014, and until the member's successor is appointed.
23However, of the members first appointed to the commission, the
24Governor shall designate three members to serve for three years;
25three of the members to serve for two years; and three of the
26members to serve for one year.

27(d) Compensation and expenses.--Members of the commission
28serve without compensation but shall be reimbursed for mileage
29and actual expenses incurred in carrying out their
30responsibilities under this act.

1(e) Chairperson.--The members of the commission shall elect
2a member as chairperson of the commission.

3(f) Action.--The concurrence of at least five members is
4required for any formal commission action.

5Section 5. Duties.

6The chairperson shall call at least one meeting per calendar
7year, no later than June 1, at which the commission shall
8establish the salary of members of the General Assembly and the
9amount of additional compensation to be paid to officers and
10leaders of the Senate and House of Representatives for the
11period beginning December 1 of the same calendar year and ending
12November 30 of the subsequent calendar year. The commission may
13not establish a salary amount that is less than the salary
14amount established for the immediately preceding period
15beginning December 1 and ending November 30.

16Section 6. Repeals.

17Repeals are as follows:

18(1) The General Assembly declares that the repeal under
19paragraph (2) is necessary to effectuate this act.

20(2) Section (4) of the act of September 30, 1983
21(P.L.160, No.39), known as the Public Official Compensation
22Law, is repealed.

23Section 7. Effective date.

24This act shall take effect immediately.
