                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, providing for an offense relating to
     3     barriers obstructing certain roadways, lanes or trails.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 18 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 6911.  Certain barriers prohibited.
     9     (a)  Chains, cables, wires, ropes or other flexible strand
    10  devices.--It shall be unlawful for any person to construct,
    11  erect, maintain or allow to remain on their property any chain,
    12  cable, wire, rope or other flexible strand device that crosses
    13  and obstructs any public or private roadway, lane, trail or path
    14  by preventing or restricting pedestrian or vehicular traffic on
    15  such roadway, lane, trail or path.
    16     (b)  Other obstructions.--It shall be unlawful to erect any
    17  type of barrier, including, but not limited to, fences, gates,


     1  poles or posts that obstruct any public or private roadway,
     2  lane, trail or path by preventing or restricting vehicular
     3  traffic, unless a sign or signs indicating the presence of the
     4  obstruction is posted on or about such a barrier. The signs
     5  shall be at least four square feet in size, made from
     6  fluorescent or similar material visible at night, and shall be
     7  clearly visible at least 50 feet from any direction from which
     8  the obstruction could be approached by vehicular traffic.
     9     (c)  Exception.--The provisions of subsection (a) shall not
    10  apply to any chain crossing or obstructing any driveway or
    11  similar roadway leading directly to a place of residence, which
    12  is posted with a sign which meets the requirements of subsection
    13  (b).
    14     (d)  Penalties.--
    15         (1)  A person who violates subsection (a) commits a
    16     misdemeanor of the third degree.
    17         (2)  A person who violates subsection (b) commits a
    18     summary offense.
    19     Section 2.  This act shall take effect in 60 days.
