                                     AN ACT

     1  Amending the act of June 1, 1945 (P.L.1232, No.427), entitled
     2     "An act providing for and regulating the appointment,
     3     promotion and reduction in rank, suspension and removal of
     4     paid operators of fire apparatus in boroughs, incorporated
     5     towns and townships of the first class; creating a civil
     6     service commission in each borough, incorporated town and
     7     township of the first class; defining the duties of such
     8     civil service commission; imposing certain duties and
     9     expenses on boroughs, incorporated towns and townships of the
    10     first class; imposing penalties; and repealing inconsistent
    11     laws," granting additional powers to the civil service
    12     commission relating to the scheduling of applicants' physical
    13     examinations.

    14     The General Assembly of the Commonwealth of Pennsylvania
    15  hereby enacts as follows:
    16     Section 1.  Sections 11 and 19, act of June 1, 1945
    17  (P.L.1232, No.427), entitled "An act providing for and
    18  regulating the appointment, promotion and reduction in rank,
    19  suspension and removal of paid operators of fire apparatus in
    20  boroughs, incorporated towns and townships of the first class;
    21  creating a civil service commission in each borough,
    22  incorporated town and township of the first class; defining the
    23  duties of such civil service commission; imposing certain duties

     1  and expenses on boroughs, incorporated towns and townships of
     2  the first class; imposing penalties; and repealing inconsistent
     3  laws," granting additional powers to the civil service
     4  commission relating to the scheduling of applicants' physical
     5  examinations," are amended to read:
     6     Section 11.  General Provisions Relating to Examinations.--
     7  Each commission shall make rules and regulations to be approved,
     8  as provided in section six hereof, providing for the
     9  examinations of applicants for positions as fire apparatus
    10  operators and for promotion thereof, which rules and regulations
    11  shall prescribe the minimum qualifications of all applicants to
    12  be examined and passing grades. All examinations for promotions,
    13  or positions as fire apparatus operators of any municipality,
    14  shall be practical in character and shall relate to such
    15  matters, and include such inquiries as will test the merit and
    16  fitness of the persons examined to discharge the duties of the
    17  employment sought by them.
    18     All examinations shall be open to all applicants who have the
    19  minimum qualifications required by the rules and regulations.
    20  Each applicant for examination shall be subject to the
    21  regulations adopted by the commission and shall be required to
    22  submit to a physical examination either before or after being
    23  admitted to the regular examination held by the commission.
    24     Public notice of the time and place of every examination,
    25  together with the information as to the kind of position or
    26  place to be filled, shall be given by publication, once in a
    27  newspaper of general circulation in the municipality, or in a
    28  newspaper circulating generally in the municipality at least two
    29  weeks prior to each examination, and a copy of the notice shall
    30  be prominently posted in the office of the commission or other

     1  public place.
     2     The commission shall post in its office the eligible list
     3  containing the names and grades of those who have passed the
     4  examination for position.
     5     Under this act, soldiers as defined by the act, approved the
     6  fifth day of August, one thousand nine hundred forty-one
     7  (Pamphlet Laws, eight hundred seventy-two), who have
     8  successfully passed the examination shall be given the
     9  additional credits provided for by said act.
    10     Section 19.  Physical Examinations.--All applicants for
    11  examination shall undergo a physical examination as provided in
    12  section 11 which shall be conducted under the supervision of a
    13  doctor of medicine appointed by the civil service commission. No
    14  person shall be eligible [to take an examination] for
    15  appointment until said doctor certifies that the applicant is
    16  free from any bodily or mental defects, deformity, or disease
    17  that might incapacitate him from the discharge of the duties of
    18  the position desired.
    19     Section 2.  This act shall take effect immediately.
