                                     AN ACT

     1  Providing for a referendum on the question of municipalities
     2     participating in the National Flood Insurance Program.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  (a)  At the municipal or general election held
     6  more than 90 days after enactment of this act, there shall be a
     7  referendum in each county having flood prone areas regarding
     8  participation in the National Flood Insurance Program.
     9     (b)  The question shall be presented in substantially the
    10  following form:
    11     Shall (name of the city, borough, incorporated town or
    12  township) participate in the National Flood Insurance Program?
    13     (c)  If a majority of the electors voting on the question
    14  vote "yes", the municipal corporation shall implement the
    15  National Flood Insurance Program.
    16     (d)  If a majority of the electors voting on the question


     1  vote "no", or if there is a tie vote, the question shall fail
     2  and the municipal corporation shall not be required to
     3  participate in the National Flood Insurance Program, however,
     4  the negative vote notwithstanding, the municipal corporation
     5  may, by ordinance or resolution, become a participant or
     6  continue participation in the National Flood Insurance Program.
     7     Section 2.  The Department of Community Affairs shall
     8  forthwith send copies of the Federal map which identifies flood
     9  prone areas to the board of commissioners of each county. The
    10  map shall also be available to all municipal corporations and
    11  persons who request copies.
    12     Section 3.  This act shall take effect in 60 days.
